HomeMy WebLinkAboutResolutions - 1981.06.04 - 14806Drain has und taken proceedings for the construction of the Moffitt May 21, 1981 Miscellaneous Resolution # 81192 BY: PLANNING AND BUILDING COMMITTEE IN RE: CONSENT TO STORM DRAINAGE APPORTIO=NT FOR THE MOFFITT DRAIN TO THE OAKLAND C0777 BOARD OF CG=SSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, pursuant to a petition filed by the Charter Town- ship of Waterford the statutory drainage board for the Moffitt Drain under the provisions of Chapter 20 of Act No. 40 of the Public Acts of Michigan, 1956, as amended; and WHEREAS, it now appears that said Moffitt Drain will not be constructed because the necessary financing cannot be arranged; and WHEREAS, said Moffitt Drain would have provided storm drain- age necessary for the County Complex; and WHEREAS, Section 468 of Chapter 20 of said Act No, 40 of the Public Acts of Michigan, 1956, as amended', provides that the appor- tionment of the cost of an intra-county drain project against the county shall be based solely upon drainage of county highways unless the county board of commissioners shall assume additional cost of the drain by a vote of 2/3 of the members elect of the said board of commissioners; and NOW, THEREFORE, RESOLVED BY THE OAKLAND COUNTY BOARD OF TrP WHEREAS, the Drainage Board for the Moffitt Drain has tenta- tively apportioned the cost of said drain as follows: CHARTER TOWNSHIP OF WATERFORD 60.13119% STATE OF MICHIGAN, on account of drainage of state highways 0.53824% COUNTY OF OAKLAND on account of drainage county highways on account of the County Complex 15.10989% 24.22068% 100.00000% WHEREAS, said Drainage Board deems it advisable and necessary to obtain from this Board a resolution assuming 24.22063% of the cost of said Moffitt Drain in addition to the 15.10989% apportioned to the County of Oakland on account of drainage of county highways. COMMISSIONERS: 1. That pursuant to the authorization provided in Section 468 of Chapter 20 of Act No. 40 of the Public Acts of Michigan, 1956, as amended, the County of Oakland does hereby assume 24.22068% of the cost of the Moffitt Drain in addition to 15.10989% apportioned to the County of Oakland on account of drainage of county highways. 2. That the County of Oakland does hereby consent to the entry of a Final Order of Apportionment apportioning a total of 39.33059% of the cost of the Moffitt Drain to the County of Oakland. 3. That all resolutions and parts of resolutions insofar as the same may be in conflict with the provisions of this resolution be and the same hereby are rescinded. (. il1iarn Caddol Chairman MR. FINANCE COMMITTEE 4th day of June 19 81 AL #81192 June 4, 1981 Moved by Caddell supported by Jackson the report be accepted and Resolution #81I92 be adopted.
