HomeMy WebLinkAboutResolutions - 1974.06.20 - 15149The following resolution is with reference to THE "SOIL EROSION AND SEDIMENTATION CONTROL ACT 347, MICHIGAN 1972" AND IS FOR THE PURPOSE OF APPLYING TO THE WATER RESOURCES COMMISSION FOR DESIGNATION OF THE DEPARTMENT OF PUBLIC WORKS AS AN "AUTHORIZED PUBLIC AGENCY" RESPONSIBLE FOR SOIL EROSION AND SEDIMENTATION CONTROL FOR ITS OWN PROJECTS. and since a copy of the resolution has, prior to this meeting been mailed to ' all members of this Board -----I respectfully request that reading of same be waived. The fublic Works Committee, by Mr. Patnaies its Chairman • moves the doption oy the following Re solution: At a regular meeting of the Board of Commissioners of Oakland County', Michigan, held in the Commissioners' Auditorium in the County Service Center, in the City of Pontiac, Michigan, on Thursday the 20th day of o'clock A, M. , Eastern Standard Time. , 1974, at 9:30 AN June PRESENT: Berman, Brotherton, Burley, Button, Dearborn, Douglas, Dunleavy, Gabler, Hobart, Hoot, Houghten, Kasper, Lennon, Mathews, Moffitt, Montante, Nowak, Olson, Patnales, Perinoff, Pernick, Quinn, Richardson, Vogt, Walker, Wilcox. (26) ABSENT: Coy, (1) Misc. Res. No. 6735 Recommended by the BOARD OF PUBLIC WORKS Re: Soil Erosion and Sedimentation Control Act 347, Mich. 1972 RESOLUTION WHEREAS, Act 347, Michigan Public Acts of 1972, The Soil Erosion and Sedimentation Control Act of 1972, became effective January 1, 1973; and WHEREAS, said Act 347 provides for the control of soil erosion and the protection of the waters of the state from sedimentation; prescribes the powers, duties and functions of state and local agencies; provides for the promulgation of rules; and provides remedies and penalties; and WHEREAS, said Act 347 provides that a county agency be designated as the county enforcing agency by the County Board of Commissioners; and further provides that a county agency may apply to the Water Resources Commission for designation as an "authorized public agency" with the authority to enforce its own soil erosion and seWmentation control requirements with regard to all land uses undertaken by the agency; and WHEREAS, the Oakland County Board of Commissioners passed a resolution on July 19, 19 7 3, designating the dffice of the Oakland County Drain Commissioner as the county enforcing agency .; and WHEREAS, the Oakland County Drain Commissioner sent a letter dated May 8, 1974 to the Director of the Oakland County Department of Public Wocks, urging that the Oakland County Department of Public Works seek the designation, "autl,orized public agency"; and WHEREAS, it appears that it would be beneficial and more efficient if the Oakland County Department of Public Works were to control and enforce it's own soil erosion and sedimentation control program for all of its' projects. THEREFORE, be it resolved that the Director of the Oakland County Department of Public Works is hereby authorized to apply to the Water Resources Commission for designation of the Oakland County Department of Public Works as an "authorized public agency" and submit to the Water Resources Commission the soil erosion and sedimentation control procedures governing projects under- taken by the Oakland County Department of Public Works in order that said desig- nation be granted.
