Nowak, Chairman IN RE: SUPPORT OF DOCTRINE OF SEPARATION OF POWERS AND THEORY OF CHECKS AND BALANCES TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairman, Ladies and Gentlemen: WHEREAS County Commissioners are charged with the responsibility of adopting a budget to operate the County; and WHEREAS part of such duties is for the Commissioners to determine the priorities of various needs and requirements and the salaries to be paid to County employees; and WHEREAS the Third Judicial Circuit Court has encroached upon the legislative and administrative powers of the Wayne County Board of Commissioners; and WHEREAS these United States and the States therein, were founded on the doctrine of the separation of powers and the theory of checks and balances, and that to permit one co-equal branch of government to interfere with and exercise the powers of another co-equal branch of government destroys the tenets of a Republic; and WHEREAS the Oakland County Board of Commissioners objects to the encroachment by any other co-equal branch of government upon the legislative and administrative duties of County Commissioners; NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners records its support of the doctrine of separation of powers and the theory of checks and balances.
