Dearborn, Chairman IN RE: AMENDMENT TO OAKLAND COUNTY EMPLOYEES RETIREMENT SYSTEM RESOLUTION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairman, Ladies and Gentlemen: WHEREAS Section 29 of the Oakland County Employees Retirement Plan presently provides for an automatic retirement allowance for widows or dependent totally disabled widowers of members who die while in County empl3yment provided such member has 25 years of service or has attained age 60 with 10 years of service; and WHEREAS the Oakland County Retirement Commission has recommended on amendment effective retroactively to January 1, 1973 which would make this benefit applicable to dependent spouses of members with 15 years of service or at age 60 with 10 years of service; NOW THEREFORE BE IT RESOLVED that Section 29, "Non-Duty Death Retirement Allowance" of the Oakland County Employees Retirement Resolution, as amended, be further amended effective January 1, 1973 to read as follows: Section 29. Any member who continues in the employ of the County on or after the date he either (1) acquires 25 15 years of credited service, or (2) attains age 60 years and has 10 or more years of credited service, whichever occurs first, and does not have an option A election in force, as provided in section 28 and (1) dies while in County employment and (2) leaves a SPOUSE, wi:Eksvo-7-exr4-n-i4te--ease-e-f-e-femalc rrrembeteleetyes- e-wkIowee whom the Commission finds to--leeet-ert-a-11-yeewrd-perrnement-ly-erts-ab-Ieel-arrel to have been dependent upon the female member for at /east 50 per cent of his financial support, the SPOUSE w4dow-orovv-i-doweer shall immediately receive a retirement allowance computed in the same manner in all respects as if the member had (1) retired the day preceding the date of his death, notwithstanding that he might not have attained age 60 years, (2) elected option A provided in section 27, and (3) nominated his wielow-ee-rrower SPOUSE as beneficiary. No retirement allowance shall be paid under this section on #6495 account of the death of a member if any benefits are paid or payable under section 34 on account of his death.
