KUHN OAKLAND COUNTY DRAIN COMMISSIONER PUBLIC WORKS DRIVE PONTIAC, MICHIGAN 48054 FEDERAL 8-4585 November 1, 1973 Honorable Commissioners County of Oakland 1200 North Telegraph Road Pontiac, Michigan Reference: EMILY DRAIN Mr— Chairman, Ladies & Gentlemen: There is submitted to you herewith a certified copy of a resolution adopted by the Drainage Board for the Emily Drain authorizing the issuance of Drain Bonds in the aggregate principal amount of $850,000.00 _pursuant to the provisions of Chapter 20 of Act No. 40 of the Public Acts of 1956, as amended, and other applicable law. Also submitted to you herewith is a form of proposed resolution for adoption by the Board of Commissioners for the purpose of pledging the full faith and credit of the County of Oakland as secondary security for the payment of said Drain Bonds. The said Drain Bonds are issued- in anticipation of the payment by the City of Southfield and the County of Oakland in the aggregate amount of at least equal to the amountof said Bonds. The full faith and credit of said public corporation is pledged, by law, to the prompt payment of said assessments and the interest thereon when due. The law further authorizes and obligates said public corporation to levy a tax in an amount sufficient to make said payment (unless other funds are on hand available for said purpose)which tax may be levied . without limitation as to rate or amount. Kuhn, Chairman Emily Drainage Board No. 1 Public Works Drive Pontiac, Michigan 48054 Re: Bids for the Construction of Section II of the Emily Drain Dear Sir: Pursuant to the directions of the Board given at the meeting of September 19, 1973, we have examined the bids received for the subject project and herein present our recommendation. We have reviewed the proposals submitted for completeness and correctness. A number of errors in extension of unit prices and in summation of the extensions were noted and have been corrected in the tabulation of bids„ These errors do not change the relative standings of the bidders as first read. Ten (10) copies of the bid tabulation are enclosed. CHAIRMAN, LADIES AND GENTLEMEN: WHE.13, proceedings have been taken by the Statutory Drainage Board for the construction of the Emily Drain under the provisions of Charter 20 of Act No. 40 of the Public Act of 1956, as amended, pursuant to a petition filed bv the City of Southfield on November 13, 1970; and WHEREAS, the sa:Td Drainage Beard by resolution ade., on Oc:eber 31, 1973, authorized and provided for the issuance of bonds in the aggi. crincipal amount of $850,000 ill anticipation of the collection of an equal amount of special assessments agairrt the City of Southfield, said special assessments having been there- fore duly confirmed by said Drainage Beard; and WHEREA S , said bonds are to be designated Drain Bonds, are to be dated November 1, 1973, will bear interest at a rate not exceeding 67, and will be subject to redemption prior to maturity in accordance with the provisions of the bond resolution; and Section 474 of said Act No. 40, as at...::ded, provides in part as follows: if any public corporation fails or neglects to ac c ount to the county trean .:r for the amount to any installment and interest, then the ensy treasurr shall adv:_:e the amount thereof from county funds in the nilowing County Funds, and the County ' ron is'directed Mrttely "(1) If any bonds or other evidence of indebtedness have been issued to finance a project, the petition for which was filed after June 6, 1961 in anticipation of the collection of the installment and interest pursuant to the provisions of this chapter and the board of supervisors has previously acted, by a resolution adopted by a 2/3 vote of its members elect, to pledge the full faith and credit of the county for the prompt payment of the principal of and interest on the bonds or evidence of indebtedness, or "(2) If any bonds, or other evidence of indebtedness have been issued to finance a project, the petition for which was filed prior to Juno 6, 1901 in anticipation of the collection of the installment and interest pursuant to the provisions of this chapter." WHEREAS, said Drainage Board deems it advisable and necessary to obtain from this Board a resolution consenting to the pledge of the full faith and credit of the county on the aforesaid bonds; and WHEREAS, the said drai7-, project is immediately necessary to protect and preserve the public health and therefore it is in the best interest of the County of Oakland :'that said bonds be sold.
