Oakland County held in the Commissioner's Auditorium in the County

IN RE: CLINTON OAKLAND SEWAGE DISPOSAL SYSTEM-WATERFORD EXTENSIONS-PHASE III

Mr. Chairman, Ladies and Gentlemen:
RESOLUTION PROPOSED BY OAKLAND COUNTY
BOARD OF PUBLIC WORKS WITH RESPECT TO
CLINTON-OAKLAND SEWAGE DISPOSAL SYSTEM
- WATERFORD EXTENSIONS, PHASE III
WHEREAS, the following resoltition has been received from
the Charter Township of Waterford:

CLINTON-OAXLAND SEWAGE DISPOSAL
SYSTEM - WATERFORD EXWENSIONS

WHEREAS, the Charter Township of Waterford and the County
of Oakland have entered into a Contract, dated as of April 1, 1960,
with respect to acquisition of the Waterford Extensions to the
("Linton-OakIPmri Sewage Disposal System! which Waterford Extensions
are described in said Contract as Phas c I, II and III; and -
WHEREAS, projects for the cdnstruction of Phase I and
Phase 11 are now underway and Phase I is substantially completed
and there are surplus grant and bond proceeds on hand with the
County of Oakland from the $17,000,000 of bonds issued and grants
received by said County to finance a0u.isition of said Phase

WHEREAS, the Charter Township of Waterford desires further
to extend sanitary- sewage disposal facilities and services to
certain areas of said Township as hereinafter described as part of
Phase III in accordance with plans and specifications prepared by
the engineers for this project in the7own!73hip; and
WHEREAS, in order to provide, such additional. sanitary
sewage disposal facilities and services, it is necessary to con-
struct sanitary sewers along Walton Boulevard in the Charter
Township of Waterford substantially as1 set forth in Exhibit 'A"
attached hereto and by this reference made a part hereof and in
accordance with the plans and specifications, which sanitary
sewers are included in Phase III. of thle Waterford Extensions to
the sewage disposal system in said Township and are estimated to
cost the amount set forth, on the estimates of cost prepared by
the engineers and attached hereto as Exhibit n B" and by this
reference made a part hereof; and
WHEREAS, said contract provides that surplus funds re-
maining after payment of all costs incurred in acquiring said
system may be used tc, cnnstruct additional sewers or sewage dis-
posal improvements in the Charter Tirhip .of Waterford if the
Oakland
resolution upon the request of the Charter Township of Waterford;
and
WHEREAS, all costs incurred in acquiring said Phase T
of the Waterford Extensions have been paid or provided for and
such a surplus does now exist; and
WHEREAS, the Charter Townshajp, of Waterford and the County
of Oakland will supplement the Clinton.-Oakiand Sewage Disposal
S stem Contract - Waterford Extensjon, dated as of April 1, 1969,
to provide for the acquisition of Phase III pursuant to said
Contract, and to Lssue county bonds in the aggregate principal
amount of the cost of Phase III to finance the acquisition of
sanitary sewers in accordance with tie provisions of said Contract
dated as of April 1, 1969; and
County Board of Commissioners lshall consent thereto by
Nays None ,
WHEREAS, it would now be advantageous for the Charter
Township of Waterford to transfer part of the surplus funds now
remaining from the bonds issued and grants received to finance
Phase I pursuant to the Contract dated as of April 1, 1969, to
the Phase III project to be acquired pursuant to said Contract
and for the County of Oakland to use said funds so transferred in
accordance with. the provisions of said, Contract dated as of April
1, 1969 to commence acquisition of Phase III to the extent shown
on Exhibit
NOW, THEREFOR, BE IT RESOLVED BY THE TOWNSHIP BOARD OF
THE CHARTER TOWNSHIP OP WATERFORD, OAKLAND COUNTY, MICHIGAN, as
follows
1. That the Oakland County - Board of commissioners is
hereby requested pursuant to the said Contract dated as of April
1, 1969, to transfer UX.71:00.00 from the surplus funds now re -

• • • • maining after providing for payment of all costs incurred in
acquiring Phase I of the Clinton-Oakland Sewac Disposal System
- Waterford Extensions to the construction, fund to be created
pursuant to thE said Contract for Phas'e, III of the Waterford
Extensions.
2. That the funds so 'transferred be used by the County
in accordance with the provisions of said Contract dated as of
-Aori) 1, 1969 to build the part of Phase III described in Exhibits
A and B hereto

WHEREAS, it will be advantageous to the Charter Township
of Waterford and the County of Oakland, if a transfer of funds is
authorized by this Board of Commissioners in accordance with the
request of the Township; and
WHEREAS, the Board of Public Works has recommended
adoption of this resolution.
NO, THEREFORE, BE IT RESOLVED BY THE BOARD OF CON=S
SIONERS OF OAKLAND COUNTY, MICHIGAN, as follows:
1. That this Board of Commissioners does hereby approve
and authorize the transfer, pursuant to the provisions of the
Clinton-Oakland Sewage Disposal System Contract - Waterford
Extensions, dated as of April 1, 1969,.of from the
surplus funds now remaining after providing for payment of all
costs incurred in acquiring Phase I of; the Clinton-Oakland Sewage
Disposal System - Waterford Extensions!, to the construction fund
for Phase III created pursuant to the said Contract dated as of
April 1, 1969.
2. That the surplus funds herein authorized to be
transferred shall be used by the County of Oakland through its
Department of Public Works for acquisition of part of Phase III
in accordance with the provisions . of and for the purposes described
in said Sewage Disposal Contract, dated as of April 1, 1969 and as
described on Exhibits A and B attached . to the resolution received
from the Charter Township of Waterford.
