IN RE: SUPPORT H.B. 4669 - POWERS AND DUTIES OF BOARDS OF COMMISSIONERS,
WITH AMENDMENTS
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairman, Ladies and Gentlemen:
WHEREAS your Legislative Committee has reviewed in detail House Bill 4669 and
would be supportive of it provided it were amended as follows:
Page 2, line 5 -From: "commissioners elected and serving"
To: "commissioners elected and present"
Page 2, lines 10-12 - From: "No votes shall: be taken by secret ballot except
when voting for chairman or vice chairman of the
board . . ." 1
To: "No votes shall be taken by secret ballot except
when voting for chairman or vice chairman of the
board a secret ballot may be taken."
Page 3 = DELETE the last sentence, which reads:
"No commissioner, during the term he is elected a member of
such board, shall be eligible to election or appointment to any
other county office or position, the election or appointment of
which is within the jurisdiction of such board of commissioners."
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners
hereby supports House Bill 4669, with the amendments set forth above, and that certified
copies of this resolution be forwarded to the Oakland County Legislators.
The Legislative Committee, by Marguerite Simson, Chairman, moves the adoption
of the foregoing resolution.

A sufficient majority having voted therefor, the resolution

A hill to amend section 3 of Act No. 156 of the Public
Acts of 1851, entitled as amended
"An act to define the powers and duties of the boards of
commissioners of the several counties, and to confer upon
them certain, local, administrative and legislative powers;
and to prescribe penalties for the violation of the provisions
of this act,"
as amended by Act No. 5 of the Public Acts of 1969, being
section 46,3 of the Compiled Lows of 1948,
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
Section 1, Section 3 of Act No, 156 of the Public
2 Acts of 1851, as amended by Act No. 5 of the Public Acts
3 of 1969, being section 46.3 of the Compiled Laws of 1948,
4 is amended to read as 'follows:

COMMISSIONERS
1 Sec. 3. A majority of the -i.up4i.v.i-p-s of any county
2 04111 constitute a quorum for the transaction of the ordinary

4 their meetings shall be determined by the votes of a majority

6 or adoption of any measure or resolution, or the allowance
7 of any claim against the county, in which case a majority
8 of all the members elected and serving shall be necessary.

10 upon, an electrical roll call system may be used, No votes
11 shall be taken by secret ballot except when voting for

19 TO EXCEED 2 YEARS. The chairman shall preside at all
20 meetings of the'board during the year, if present, but
21 in case of his absence from any meeting, the yice-chairman
22 shall preside. Every chairman ' MAY
23 administer an oath to any person concerning any matter
24 submitted to the board or connected with the discharge of
25 their duties, to issue subpoenas for witnesses and to

1 compel their attendance in the same manner as courts of law.
2 The hoard may provide for the designation of 1 of its members
3 to affix his signature to all contracts, bonds and other
4 documents requiring the signature of the chairman, when the
5 chairman is unable to so do because of illness or any other
6 exigency which, in the opinion of the board, prevents the
7 chairman from performing such functions of his office, No
