RESOLUTION NO. 5759
RE: COUNSEL FOR MARBLE FACING PROBLEM
ON COURT HOUSE COMPLEX
BY: FINANCE COMMITTEE - Mr. Brennan
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
MR. CHAIRMAN, LADIES AND GENTLEMEN:
WHEREAS, Miscellaneous Resolution No 5701 was referred to
the Finance Committee; and
WHEREAS, your Committee believes outside legal counsel should
be retained to assist the Corporation Counsel in investigating the
legal ramifications of the marble facing problem on the Court House
Complex.
NOW THEREFORE BE IT RESOLVED that the Corporation Counsel be
and is hereby authorized to engage outside counsel at a fee not
to exceed $3,000.00, to counsel with the Corporation Counsel and
advise this Board as to the legal ramifications of the marble facing
problem.
BE IT FURTHER RESOLVED that the sum of $3,000.00 be transferred
from the Building Fund to the Corporation Counsel Budget for this
purpose.
The Finance Committee, by Mr. James M. Brennan, Chairman, moves

Moved by Brennan supported by Szabo the resolution be adopted.
Discussion followed.
Moved by Barakat supported by Edwards the resolution be amended
to initiate litigation rather than to discover whether there is
litigation possible; the Corporation Counsel be authorized to take whatever
steps are necessary to initiate suit and report back to the Board.
