RESOLUTION NO,
RE: CIRCUIT JUDGES SALARY INCREASE
BY: PERSONNEL PRACTICES COMMITTEE - Mr. Mainland
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
MR. CHAIRMAN, LADIES AND GENTLEMEN: 1
WHEREAS, Act 248 of the Public Acts of 1970, establishes the
salary of each circuit judge in the State of Michigan at the sum
of $25,000.00 per year, payable by the State; and
WHEREAS, Act 248 further provides that the Board of Commis-
sioners, at its discretion, may vote to pay the judges of its
county a salary in addition to the salary received from the State,
and in no case shall the total of the 1State salary and the County
salary exceed $35,000.00 per year; and
. WHEREAS, the County of Oakland is, presently paying the Circuit
judges the sum of $10,000.00 per year and may increase their salary
to the sum of $11,000.00 per year to bring the salary of the circuit
judges to $35,000.00 per year; and
WHEREAS, your Personnel Practices Committee recommends that
the County of Oakland pay its circuit !judges the sum of $11,000.00
per year, effective July 1, 1971.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners determines and hereby elects to pay its circuit judges
the sum of $11,000.00 per year, effective July 1, 1971.
The Personnel Practices Committee, by Mr. William L. Mainland,
Chairman, moves the adoption of the foregoing resolution.

Mr. Mainland requested that the resolution be referred to
the Finance Committee.
Discussion followed.
Moved by Brennan supported by Szabo the resolution be amended
by changing the fifth paragraph to read aslfollows:
"NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners determines and hereby elects to pay its Circuit Judges the
sum of $11,000.00 per year, effective Julyl 1, 1971, providing the Circuit
Judges agree to sign waivers of all claimsi for additional salary amounts
due to past, present or future changes in the formula for distribution of
their salary burden between the state and county governments."
Discussion followed.
Moved by Gabler supported by Daly the resolution and amendment
be laid on the table until the question of the salary of the Circuit
Judges has been adjudicated by the Courts.
AYES: Simson, Szabo, Barakat, Bawden, Brennan, Coy, Daly,
Edwards, Gabler, Harrison, Horton, Houghten, Olson, Perinoff, Pernick,
Richards, Richardson. (17)
NAYS: Aaron, Burley, Hamlin, Kasper, Lennon, Mainland,
Mathews, Powell. (8)
A sufficient majority having voted therefor, the motion carried.

WHEREAS, Act 248 of the Public Acts of 1970, establishes the
salary of each circuit judge in the State of Michigan at the sum
of $25,000.00 per year, payable by the State; and
WHEREAS, Act 248 further provides that the Board of Commis-
sioners, at its discretion, may vote to pay the judges of its
county a salary in addition to the salary received from the State,
and in no case shall the total of the State salary and the County
salary exceed $35,000.00 per year; and
. WHEREAS, the County of Oakland iS presently paying the Circuit
judges the sum of $10,000.00 per year and may increase their salary
to the sum of $11,000.00 per year to bring the salary of the circuit
judges to $35,000.00 per year; and
WHEREAS, your Personnel Practices Committee recommends that
the County of Oakland pay its circuit judges the sum of $11,000.00
per year, effective July 1, 1971.

Commissioners determines and hereby elects to pay its circuit judges
the sum of $11,000.00 per year, effective July 1, 1971.
