CHAIRMAN, LADIES & GENTLEMEN: WHEREAS, House Bill 4135 provides for three year staggered terms for the office of County Road Commissioner in lieu of the present six year term; and WHEREAS, a shorter term of office would make the appointed road commissioners more responsiVe to Ithe needs and desires of the people of Oakland County; NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners supports House Bill 4135. A bill to amend section 7 of chapter 4 of Act No. 283 of tie Public Acts of 1909, entitled as amended "In act to revise, consolidate i.nd add to the laws relating to the establishment, opening, ciscontinuing, vacating, c osing, altering, improvement, maintenance and use of the piblic highways and private roacs, the condemnation of p operty and gravel therefor; tie building, repairing and p eservation of bridges; settinc and protecting shade trees, thainage, cutting geeds and brush within this state, and ploviding for the election or appointment and defining tie powers, duties and compensation of state, county, town- slip and district highway officials," b4 ing section 224.7 of the ICompiled Laws of 1948. THE PEOPLE OF THE STATE OF MICHIGAN ENACT: 1 Section 1. Section 7 of chapter 4 of Act No. 283 of 2 t e Public Acts of 1909, being section 224,7 of the Compiled 3•ws of 1948, is amended to rear as follows: 4 135 2 Sec.'-7. Any person elected or appointed county road 3 commissioner shall, within 10 days after being notified in 4 writing by the clerk of such county of his election or ap- • 5 pointment, take and subscribe the constitutional oath of 6 office and file the same with said clerk. Each and every 7 county road commissioner shall be required to execute and 8 give official bond in such amount as the board of super- 9 visors of such county May determine, the expense of secur- 10 ing such bond, if any to be plid from the county road fund, 11 The term of office of the firs: commissioners elected or 12 Ippointed in any county under chis act, shall commence im- 13 -lediately upon filing such oan of office and bond, and 14 ;hall continue as herein proviled. The successor to each 15 ELECTED commissioner shall be elected at the general 16 ,alection on the first Tuesday after the first Monday in 17 qovember preceding the expiration of his term. They shall 18 -told office for 2, 4 and 6 yes respectively, from the- 19 said -f-i-r-s-t----day—of January 1; zld thereafter 1 commissioner 20 shall be elected Qp-app,ol-ryd biennially for the full term 21 of 6 years. APPOINTED COUNTY ROAD COMMISSIONERS SHALL BE 22 APPOINTED FOR 3-YEAR TERMS OF OFFICES. THE FIRST MEMBER 23 SHALL BE APPOINTED FOR I YEAR, THE SECOND MEMBER FOR 2 YEARS 24 AND THE THIRD MEMBER FOR 3 YEA-;S, THEREAFTER 1 MEMBER SHALL 1191 '71 H. 4135 BE APPOINTED EACH YEAR FOR A 3-YEAR TERM, APPOINTED MEMBERS PRESENTLY SERVING MAY CONTINUE TO SERVE THE REMAINDER OF THEIR 3 TERM OF YEARS. No member of the board of supervisors shall 4 he eligible to the office of county road commissioner, and 5 such offices shall not be held by the tame person at the 6 same time. 491 '71 Moved by Pernick supported by Perinoff the resolution be adopted. A sufficient majority having voted therefor, the resolution was adopted.
