RE: FINANCE COMMITTEE REPORT-NUMBER OF VOTES REQUIRED TO AWARD
CONSTRUCTION CONTRACTS
BY: FINANCE COMMITTEE - Mr. Houghten
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
MR, CHAIRMAN, LADIES AND GENTLEMEN:
WHEREAS, Mr. Powell, a member of the Finance Committee, re-
quested an opinion of the Corporation Counsel as to the number of -
votes required for the awarding of construction Contracts; and
WHEREAS, the Corporation Counsel has submitted an opinion
pertaining to the number of votes required to award construction
Contracts; and
WHEREAS, your Committee recommends that each member of the
Board of Commissioners be furnished with a copy of said opinion.
NOW THEREFORE BE IT RESOLVED that the opinion of the Corpor-
ation Counsel as to the number of votes required for the awarding •
of construction Contracts, be received and each member of the Board
of Commissioners be furnished a copy of said opinion.
MR. CHAIRMAN, on behalf of the Finance Committee, I move the ,
adoption of the foregoing resolution.

Dear Sir:
At your meeting of March 3, 1970, I note the question was
raised by Mr. Powell and an opinion requested, as to whether a
two-thirds vote by the members of the Board of Supervisors is
needed to award a contract.. To answer the question It must be
divided into tuo parts. First, the ow ,,stion concerning, the erec-
tion of County buildings; and second, other construction contracts,.
M.S.A. 5,331, heir7. ec. 11 of ::,ot 156 of the Public Acts
of 1851, as amended, sets forth in nArrann 6 the power of the
Board of Sunervisors to cause to he erected the necessary buildings -
for poor houses, jails, county offices and other county ho'] d
The provisions of M.S.A. 5..rn, Sec. 12 of sail Act 156 requires a
two-thirds vote when exoercisinF. the power Frauted in para7raph 6
of said Sec. 11.
As to the construction contracts other than the abo..-e mention-
ed contracts, there is no requirement for a two-thirds -,rts and a
simple majority of the -,:hers elect of the Beard of Super ,.-isors
would be miffic5ent.

be adopted.
A sufficient majority having voted therefor, the resolution
was adopted.
