RESOLUTION NO, 5347
RE: ROAD COMMISSION RIGHTS-OF-WAY
BY: PUBLIC WORKS COMMITTEE -Mr. Horton
TO THE OAKLAND COUNTY BOARD OF SUPERVISORS
MR. CHAIRMAN, LADIES AND GENTLEMEN:
WHEREAS, property owners have objected to the removal of trees
along road rights-of-way for public purposes; and
WHEREAS, there is no provision for notification to the property
owner when trees are to be removed; and
WHEREAS, your Committee recommends that the Board of Commissioners
adopts a policy that:
. The County of Oakland, any department thereof or any
public utility prior to destroying or removing any tree
greater than Four (4) inches in diameter located upon
land where the fee is held by other parties shall give
at least ten (10) days notice of its intent to destroy
or remove any tree by certified mail to the owner of
record of land where such tree is located.
2. The provisions of paragraph 1 shall not apply where the
immediate removal of any tree is necessary for the pro-
tection of the public health, safety and welfare,
NOW THEREFORE BE IT RESOLVED that the Oakland County Road Com-
mission be requested to give the Notice if an easement, right-of-way
or other written permission has not been previously secured from the
property owners, their heirs and assigns, as set forth above; and
further, that the Oakland County Road Commission be requested to in-
elude in their permits for the use of road rights-of-may the following
provisions:
1, The County of Oakland, any department thereof or any

or remove any tree by certified mail to the owner of

2. The provisions of paragraph I shall not apply where

protection of the public health, safety and welfare.

the adoption of the foregoing resolution.

A sufficient majority having voted therefor, the resolution
was adopted.
