Lanni--Oakland County Commissioner, District #11 IN RE: SUPPORT OF HB 4349 AND OPPOSITION TO SUBSTITUTE HB 4349-- RECOUPMENT OF COURT COSTS AND LEGAL PEES To the Oakland County Board of Commissioners Mr. Chairperson, Ladies, and Gentlemen: WHEREAS Oakland County has been forced to pay several attorney fees and court costs in regards to frivolous lawsuits; and WHEREAS this has cost the taxpayers in excess of $25,000; arid WHEREAS House E1.=1 4349 would allow the State to collect court costs and legal fees resulting from such lawsuits; and WHEREAS Substitute House Bill 4349 specifically excludes the State of Michigan from recouping court costs and legal fees; and WHEREAS the State and local units of government are often called upon to defend against frivolous lawsuits, which create a financial burden on the State and local governmental taxpayers. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners goes on record in support of House Bill 4349 and recommends that it be amended to permit local units of government to be awarded court costs and attorney fees. BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners goes on record in opposition of Substitute House Bill 4349. BE 17 FURTHER RESOLVED that copies of this resolution be sent to all state legislators representing Oakland County and to the Oakland County Legislative Agent.
