The Personnel Committee, having reviewed the above
referenced resolution on February 28, 1990, reports with the
recommendation that the resolution be adopted.

IN RE: SHERIFF DEPARTMENT - CONTRACTED PATROL FOR OAKLAND COUNTY
PARKS AND RECREATION
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS it is the policy of the Oakland County Board of Commissioners to permit
the Sheriffs Department to enter into contractual agreements for the purpose of Law
Enforcement Patrol Services; and
WHEREAS the Oakland County Board of Commissioners in its 1990-1991 Biennial
Budget and General Appropriation Act transferred twenty (20) Safety Officer positions to
the Sheriffs Department; and
WHEREAS six (6) of these positions were considered Park Patrol and contracted for
between the Public Safety Division and Parks and Recreation; and
WHEREAS the Sheriff Department in conjunction with Parks and Recreation is
proposing to contract for services per the attached agreement for one (1) Deputy II, two (2)
Deputy I's and fifteen (15) Part-Time Non-Eligible Park Deputies.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners authorizes the Chairperson of the Board and the Oakland County Sheriff to
enter into an agreement with the Oakland County Parks and Recreation Division for the
purpose of Law Enforcement Patrol Service at the rates included per attached Schedule A.
BE IT FURTHER RESOLVED to create a new Part-Time Non-Eligible classification
titled Park Deputy with the following hourly rates:

BE IT FURTHER RESOLVED to take certain personnel actions in the Protective
Service/Contracted Patrol-Park unit (436-16) relative to the implementation of this
contract:
1. To delete three (3) vacant Deputy I positions (1102714, #06534, and #06734)
2. To reclassify one (1) Deputy I-S position to Deputy II-A (1101788)
3. To create fifteen (15) governmental Part-Time Non-Eligible Park Deputy
positions funded for 600 hours each.
Mr. Chairperson, on behalf of the Public Services Committee, I move the adoption of
the foregoing resolution.

AGREEMENT FOR LAW ENFORCEMENT SERVICES
'q31-1,12S`AlgREEMENT made and entered into this 1st Day of March, 1990 by and between
the Oakland County Sheriff, hereinafter referred to as "SHERIFF," and the Oakland County
Parks and Recreation Commission, hereinafter referred to as "PARKS AND RECREATION".
WITNESSETH:
WHEREAS, Parks and Recreation is desirous of contracting with the Sheriff for the
performance of Park Patrol functions within its County Parks system; and
WHEREAS, the Sheriff is agreeable to rendering such services on the terms and
conditions as hereinafter set forth;
NOW THEREFORE, IT IS AGREED AS FOLLOWS:
1. The Sheriff agrees to provide police protection within the jurisdiction of Parks
System, including all private roads, said protection to consist of the enforcement of State
statutes and Parks ordinances, including the writing of tickets therefore; for the purpose of
performing such functions, the Sheriff shall furnish and supply one (1) Deputy II, two (2)
Deputy l's and fifteen (15) Part-Time Non-Eligible Park Deputies, equipment,
communication facilities and other necessary supplies needed in order to perform such
services, including all insurances, liability insurance and other protection or benefits of
whatever nature. Notwithstanding anything heretofore contained, it is agreed that in all
instances where special supplies, such as stationery, notices, forms, appearance tickets, and
the like needed to be executed in the name of Parks and Recreation shall be required, they
shall be supplied by Parks and Recreation at its cost and expense. The Sheriff agrees to hold
Parks and Recreation harmless and defend it against any suit, claim, cause of action, etc.,
as the result of any act, and/or omission to act, on the part of the Sheriff or its deputies,
and/or agents while such patrol officer employees and/or agents are under the control of the
Oakland County Sheriff or his designated representative.
2. The standards of performance, the discipline of the deputies and other matters
incident to the performance of such services and the control of the deputies so assigned to
provide such service shall remain in the Sheriff's Department; however, the standards of
performance shall not be lower than that furnished another jurisdiction in Oakland County,
nor shall the caliber and the ability of the deputies supplied by lower than that furnished
other jurisdictions in Oakland County.
3. Parks and Recreation shall not be required to assume any liability for the direct
payment of salaries, wages or other compensation to the County for any Sheriffs
Department personnel performing the services set forth in this document except as herein
otherwise specified.
4. The law enforcement service to be provided by the Sheriff shall consist of
furnishing one (1) Deputy II, two (2) Deputy Ps, and fifteen (15) Part-Time Non-Eligible Park
Deputies. Training time shall be considered as Law Enforcement Service. The
commencement time of the shift is to be determined by the usual shift starting and ending
time established by the Oakland County Sheriffs Department. Law Enforcement Services
beyond the scope of this contract are available upon request by Parks and Recreation to be
paid for at the established overtime rate or by Part-Time Non-Eligible Park Deputies.
5. Parks and Recreation agrees to pay for such law enforcement service at the
established rate consistent with the attached payment schedule, such sum to be paid
monthly. Billing shall commence on the date the deputies are assigned to Parks and
Recreation. Fractional months services will be prorated on a work day basis for the month
involve d.
6. The Sheriff shall not be required to fill-in for any time said officer is not present
due to annual leave, sick leave, personal leave or any other authorized leave time granted
unless requested by Parks and Recreation to be paid for at the established overtime rate or
by Part-Time Non-Eligible Park Deputies.
7. This twenty-two (22) month agreement shall be effective March 1, 1990 and shall
terminate December 31, 1991 provided that said agreement may be renewed for mutually
agreed contract periods thereafter by Parks and Recreation, at rates established by the
County, by giving its intentions to renew said agreement in writing to the Sheriff at least 45
days prior to the expiration date. Said notice is to be sent to the Oakland County Executive
and the Oakland County Sheriff, and be it provided further that either party hereto may
elect not to renew same by giving written notice thereof to the opposite party at least 45
days prior to the expiration date.

8. In the event said Parks and Recreation elects not to renew said Agreement by
giving notice as provided in paragraph 6, Parks and Recreation agrees that if it establishes
its own Parks Patrol it will give consideration to employ to the Oakland County Sheriffs
Deputies, if any, who will be laid off by virtue of the termination of said agreement, but in
no event does Parks and Recreation agree that it shall be obligated to hire such personnel.
9. Parks and Recreation may terminate said agreement, upon sixty (60) days
written notice delivered to the Oakland County Executive and the Oakland County Sheriff.

PARKS AND RECREATION-MISCELLANEOUS RESOLUTION #90042
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
MR. CHAIRPERSON, LADIES AND GENTLEMEN:
Pursuant to Rule XI-G of this Board, the Finance Committee has reviewed Miscellaneous
Resolution #90042 and finds:
I) The Sheriff's Department is proposing to enter into a contract with Oakland County
Parks and Recreation to provide law enforcement patrol services beginning March
1, 1990 and ending December 31, 1991.
2) Funding for six (6) Deputy 1-S positions and associated operating costs is included in
the Sheriff's Department 1990-1991 Budget for the Parks patrol function as
detailed in Schedule A-1.
3) The Sheriff's Department is requesting a staffing adjustment for this function by
deleting three (3) Deputy I-S positions, reclassifying one (1) Deputy 1-S position to
Deputy II-A, and creating fifteen (15) PINE Park Deputy positions (new
classification) at 600 hours each,
4) The estimated annual cost to provide patrol services to Parks and Recreation is
$234,783 in 1990 and $245,868 in 1991 as detailed in Schedule A.
5) These costs are consistent with the currently approved Law Enforcement Services
Agreement for the Deputy with no fill-in contract rate,
6) Approval of this contract does not commit the County to any future obligation.
7) The future level of service including personnel is contingent upon contract renewal.
8) Corporation Counsel has reviewed and approved this contract as to legal
sufficiency.
9) Approval of this proposed contract and the corresponding staffing adjustment
would necessitate the following budget amendments reducing both revenue and
expenditures in the Sheriff's Department 1990-1991 Budget as follows:
