IN RE: DETROIT AIRCRAFT SUPPLY SANITARY SEWER SERVICE AT OAKLAND/PONTIAC AIRPORT
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS Russell A. Schulte and Gretchen A. Schulte, his wife, (d.b.a.
Detroit Aircraft Supply) have a lease at the Oakland/Pontiac Airport which
expires September 30, 2000; and
WHEREAS Detroit Aircraft Supply requires sanitary sewer service from
the Township of Waterford; and
WHEREAS the Township of Waterford requires the execution of a "Payment
Agreement and Lien" to cover the tap-in charge for sanitary sewers; and
WHEREAS it is the County's desire that the said lien shall be against
Detroit Aircraft Supply and not the County of Oakland.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners hereby authorizes the Chairperson of the Board of Commissioners
to execute the necessary documents for "Payment Agreement and Lien" on the land
lease to Russell A. Schulte and Gretchen A. Schulte, his wife, (d.b.a. Detroit
Aircraft Supply (lease amendment attached).
Mr. Chairperson, on behalf of the Planning and Building Committee, I
move the adoption of the foregoing resolution.

OAKLAND PONTIAC AIRPORT
AIRPORT LAND LEASE ADDENDUM
WHEREAS, the County of Oakland, Lessor, and Russell A. Schulte and
Gretchen A. Schulte, Lessee, are parties to a certain land lease dated
Sept. 25, 1975 , and land lease addenda dated February 3, 1976 and
Oct. 1, 1980
WHEREAS, said land lease is for property located on the Oakland/Pontiac
Airport in Waterford Township, Oakland County, Michigan, and described as follows:
Commencing at the East ki corner of said Section 17 thence N 2 °17'30"
West 787.46 feet along the East line of said Section 17 and the center-
line of Airport Road; thence S 87 041'21" West 33.00 feet to the West
right-of-way line of said Airport Road and the point of beginning;
thence S 87°52'11" West 125.81 feet; thence N 2'7'49" West 159.00 feet;
thence N 87°52'11" East 125.39 feet to said North right-of-way line;
thence S 2 0 17'30" East 159.00 feet to the point of beginning. This
contains approximately 19,970.4 square feet.
WHEREAS, Paragraph 11 of said lease reads as follows:
Any grading of land, drilling well, installing of underground electric
or telephone cable, septic tank, underground fuel tanks or any other
facility above or below ground shall be done at the lessee's own expense,
including snow removal and general maintenance.
WHEREAS, Paragraph 18 of said lease reads as follows:
The lessee further agrees to pay any taxes or special assessments
hereinafter legally levied by any governmental agency against the
lands covered by this lease, including buildings or personal property
of the lessee. The non-payment of any such taxes by the lessee for
90 days shall be grounds for cancellation of this lease by the lessor.
WHEREAS, the lessee desires sanitary service from the Township of Waterford,
NOW, THEREFORE, Paragraph 5 of said lease and lease addendum dated
October 1, 1980, is hereby amended to read:

In addition to the above, lessee further agrees that an additional down
payment of $492.15 for sanitary sewer service, plus a $5.00 special permit
($497.15) for sanitary sewer service, plus a monthly payment of $66.90
for the term of this lease is in addition to the above paragraph.
Lessee further agrees that the total monthly rent of this lease as provided
in the above paragraphs is $299.88 to be effective March 1, 1984.
IN ALL OTHER RESPECTS said lease agreement shall remain in full force
and effect.
