MISCELLANEOUS RESOLUTION # 90103 May 24, 1990

IN RE: PUBLIC WORKS/FACILITIES ENGINEERING DIVISION - CONTRACT
AWARD FOR WORK RELEASE FACILITY PARKING LOT PAVING
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen;
WHEREAS by Miscellaneous Resolution #90080 of Board of Commissioners authorized
the County Executive's Facilities Engineering Division to receive bids for asphalt
surface on the parking lot at the Work Release Facility at an estimated cost of
$33,000; and
WHEREAS in accordance with bidding procedures, bids for the installation of the
above mentioned were received and opened on May 2, 1990; and
WHEREAS the County Executive's Department of Public Works has reviewed all bids
submitted and recommends that the lowest responsible bidder, Al's Asphalt Paving
Company, Inc. be awarded a contract for construction in the amount of $18,308; and
WHEREAS additional costs are estimated to be $2,392; and
WHEREAS the total cost of the above mentioned work is estimated to be
$20,700 as detailed in the attached schedule; and
WHEREAS funding for the above mentioned project is available in the 1990 Capital
Improvement Program - Utilities Fund #40200.
NOW THEREFORE BE IT RESOLVED as follows:
I) The contract proposal of Al's Asphalt Paving Company, Inc. of Taylor,
Michigan in the amount of $18,308 be accepted and the contract awarded in
concurrence with the Planning and Building Committee recommendations,
2) Funds be provided in the amount of $2,392 to cover the remaining project
costs,
3) The Chairperson of the Board of Commissioners is hereby authorized and
directed to execute a contract with Al's Asphalt Paving Company, Inc. of Taylor,
Michigan on behalf of the County of Oakland,
4) The County Executive's Department of Public Works, Facilities Engineering
Division, shall notify the awardee of this award, in writing no later than 10 days
after adoption of this resolution. The award shall not be effective until the
awardee has been notified.
Mr. Chairperson, on behalf of the Finance Committee, I move the adoption of the
foregoing resolution.

Project No.: 88-27R May 15, 1990
In accordance with authorization received on April 5, 1990, in the
form of Miscellaneous Resolution #90080, drawings and specifications for
the Work Release Facility Parking Lot Paving were prepared. The project
was re-advertised and bids were received at 2:00 p.m., on Wednesday, May
2, 1990. These bids are summarized on the attached Bid Tabulation
Sheet.
The low responsible bidder was Al's Asphalt Paving Company, Inc., of
Taylor, Michigan, with a base bid of $18,308.00. This contractor has not
performed for us before, but he has worked for the County Parks and
Recreation Commission and we have checked his other references and feel
he is qualified to perform on this project.
The project is expected to be completed by July 1, 1990, and the
total cost is estimated to be:
1. Construction $ 18,308.00
2. Administrative Expense 500.00
Funding in the amount of $20,700.00 is available from the Asphalt
Paving Program line item of the Utilities Section of the 1990 Capital
Improvement Program. We are, therefore, recommending that a contract in
the amount of $18,308.00 be awarded to Al's Asphalt Paving Company, Inc.
Further we are recommending that total project funding in the amount of
$20,700.00 be appropriated.

THIS AGREEMENT, made this the 24th day of May, 1990, by and between
the Count Y of Oakland, a Michigan Constitutional Corporation, acting
herein through its Board Of Commissioners, hereinafter called the "OWNER"
and Al's Asphalt Paving Co., Inc., 25500 Brest Rd., Taylor, MI 48180, a
corporation of the State of Michigan, hereinafter called the
"CONTRACTOR."
WITNESSETH, that the CONTRACTOR and the OWNER for the considerations
hereinafter named agree as follows:
The CONTRACTOR shall furnish all the materials, means of
construction, and other accessories and perform all of the Work shown on
the Drawings and described in the Specifications entitled:

AS PREPARED BY: The Facilities Engineering Division of the Oakland
County Executive's Department of Public Works, all in accordance with
this agreement, the General Conditions of the Contract, the Proposal, the
Specifications, and the Drawings.
The CONTRACTOR hereby agrees to commence Work under this Contract
upon receipt of written notice, and shall fully complete the Work within
thirty (30) calendar days from the notice to proceed. The OWNER shall
pay the CONTRACTOR for the performance of the Contract, subject to
additions and deductions provided therein, as follows: Eighteen Thousand
Three Hundred Eight and 00/100 ($18,308.00), which price is the base bid.
The OWNER shall process payments on account of the Contract as
provided therein, as follows: On or about the fifth (5th) day of each
month ninety (90) percent of the value, based on the Contract prices of
labor and materials incorporated in the Work and of the materials
suitably stored at the site thereof up to the last day of the previous
month, less the aggregate of previous payments; and upon substantial
completion of the entire Work, a sum sufficient to increase the total
payments to ninety-five (95) percent of the Contract price. The OWNER
may at any time after fifty (50) percent of the Work has been completed,
if he finds that satisfactory progress is being made and with written
consent of surety, approve any of the remaining partial payments for
payment in full.
Final payment shall be due thirty (30) days after completion of the
Work provided the Contract is fully performed. Before final payment, the
CONTRACTOR shall submit evidence satisfactory to the OWNER that all
payrolls, material bills, and other indebtedness connected with the Work
have been paid.

The CONTRACTOR shall furnish all the materials, means of
construction, and other accessories and perform all of the Work shown on

dollars ($573,300.00), which price includes the Base Bid and Alternate

the County of Oakland, a Michigan Constitutional Corporation, acting
herein through its Board of Commissioners, hereinafter called the "OWNER"
and Ken Daly Incorporated, 1520 N. Woodward, Suite 107, Bloomfield Hills,
Michigan, 48013, a corporation of the State of Michigan, hereinafter
called the "CONTRACTOR."
WITNESSETH, that the CONTRACTOR and the OWNER for the considerations
hereinafter named agree as follows:
The CONTRACTOR shall furnish all the materials, means of
construction, and other accessories and perform all of the Work shown on
the Drawings and described in the Specifications entitled:

AS PREPARED BY: Silberg & Associates, Electrical Consultant, and the
Facilities Engineering Division of the Oakland County Executive's
Department of Public Works, all in accordance with this agreement, the
General Conditions of the Contract, the Proposal, the Specifications, the
Drawings, and Addenda Nos. 1 & 2.
The CONTRACTOR hereby agrees to commence Work under this Contract
upon receipt of written notice to proceed, and shall fully complete the
Work within One Hundred Eighty (180) calendar days from the notice to
proceed. The OWNER shall pay the CONTRACTOR for the performance of the
Contract, subject to additions and deductions provided therein, as
follows: Five Hundred Seventy-Three Thousand Three Hundred and 00/100
dollars ($573,300.00), which price includes the Base Bid and Alternate
M-1 (Alternate E-1 not accepted).
The OWNER shall process payments on account of the Contract as
provided therein, as follows: On or about the fifth (5th) day of each
month ninety (90) percent of the value, based on the Contract prices of
labor and materials incorporated in the Work and of the materials
suitably stored at the site thereof up to the last day of the previous
month, less the aggregate of previous payments; and upon substantial
completion of the entire Work, a sum sufficient to increase the total
payments to ninety-five (95) percent of the Contract price. The OWNER
may at any time after fifty (50) percent of the Work has been completed,
if he finds that satisfactory progress is being made and with written
consent of surety, approve any of the remaining partial payments for
payment in full.
Final payment shall be due thirty (30) days after completion of the
