IN RE: Corporation Counsel - Real Estate Section - LEASE
AGREEMENT WITH THE OAKLAND COUNTY ROAD COMMISSION FOR OAKLAND
COUNTY TREASURER OFFICE SPACE
To the Oakland County Board of Commissioners
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS the County of Oakland, by Resolution 85141,
dated June 5, 1985, renewed a Lease for approximately 350 square
feet of office space at the Oakland County Road Commission
building, 31001 Lahser Road, Beverly Hills, Michigan, for the
Oakland County Treasurer, for a term of five (5) years, commenc-
ing on the first day of May, 1985, and terminating on the 30th
day of April, 1990; and
WHEREAS the Oakland County Treasurer desires to con-
tinue to provide a satellite office and supports the rental of
said office space as being in the best interests of the public;
and
WHEREAS the Road Commission has submitted the attached
Lease Agreement for the period of May 1, 1990 through April 30,
1995, which provides for the payment of $2,800 per year to
defray the costs of maintenance, custodial services and
utilities.
NOW THEREFORE BE IT RESOLVED that the Oakland County
Board of Commissioners approves the Lease Agreement between the
Oakland County Road Commission and the County of Oakland for 427
square feet of office space for the Oakland County Treasurer for
a term of five (5) years, commencing May 1, 1990, and ending
April 30, 1995, at the sum of $2,800 per year.
BE IT FURTHER RESOLVED that the Board directs its
Chairperson to execute the Lease Agreement, a copy of which is
attached hereto.
Mr. Chairperson, on behalf of the Planning and Building
Committee, I move the adoption of the foregoing resolution.

LEASE AGREEMENT
THIS LEASE AGREEMENT entered into this JAZ___ day of
A.D., 1990, by and between the Board of County Road Commissioners of aakland
County, a Public Body Corporate, hereinafter called "Lessor", located at 31001
Lahser Road, Beverly Hills, Michigan, and the County of Oakland, a Michigan
Constitutional Corporation, hereinafter called "Lessee", 1200 North Telegraph
Road, Pontiac, Michigan.
WITNESSETH:
WHEREAS, the Lessor is the owner of certain real property and
building, known and designated as 31001 Lahser Road, Beverly Hills, Michigan,
which is a part of the properties owned and used by the Lessor as
administrative offices for the Road Commission for Oakland County; and
WHEREAS, since 1976, the Lessor has leased a portion of said property
and building to the County of Oakland for use as a satellite office of the
Oakland County Treasurer; and
WHEREAS, the current lease expires on April 30, 1990; and
WHEREAS, Lessee wishes to execute another Agreement to Lease
approximately 427 square feet of office space in said building, for the purpose
of providing a satellite office of the Oakland County Treasurer; and
WHEREAS, in the opinion of the Lessor and the Lessee, the lease of
such office space, in accordance with the terms and conditions set forth
herein, would be in the best interests of the public.
NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS SET FORTH
HEREIN, IT IS MUTUALLY AGREED BY THE PARTIES HERETO, AS FOLLOWS:
1. The Lessor does hereby lease to the Lessee, subject to the terms
and conditions hereinafter set forth, approximately 427 square feet of office
space on the ground floor of the Lessor's building located at 31001 Lahser
Road, Beverly Hills, Michigan, for a term of five (5) years, commencing on the
1st day of May, 1990, and ending on the 30th day of April, 1995.
2. The Lessor grants to Lessee, during the term of this Lease, the
right of ingress and egress to the premises described as 31001 Lahser Road,
Beverly Hills, Michigan.
3. The Lessor shall provide maintenance and custodial services,
together with all heat, electricity and other utilities, except telephone
service, for such leased office space.
4. The Lessee shall pay annually to Lessor, an amount equal to the
maintenance, custodial and utility costs incurred by the Lessor, attributable
to the leased office space, together with all other variable costs associated
with the Lessor's operation and maintenance of the building within which the
leased office space is located; which costs, to be paid by Lessee hereunder,
are currently determined to be aproximately Two Thousand Eight Hundred Dollars
($2,800) per year and which shall be payable by Lessee on May 1 of each year
during the term of this Lease, commencing on May 1, 1990.
5. Lessor agrees to provide two (2) designated employee parking
spaces for the exclusive use of the employees of the Oakland County Treasurer's
Office.
6. Lessor agrees to provide the appropriate signs and/or directories
inside and outside the building, indicating the direction and location of the
satellite County Treasurer Office.
7. The Lessor agrees to permit the Lessee to use Lessor's vault.
8. Lessor agrees to provide utility space to house data processing
modems; such space is not considered a part of the leased office space, but
shall be additional space in the Lessor's general utility area
9. IT IS MUTUALLY AGREED between the parties hereto that neither the
Road Commission for Oakland County, nor its employees, shall be held liable for
any theft or loss or any other claims, injury or damage incurred by the County
of Oakland or the Oakland County Treasurer, or any other person, as a result of
or arising out of the occupancy or use of the leased office space.
10. IT IS FURTHER MUTUALLY AGREED that the parties hereto may renew
this Lease, according to terms and conditions which may be mutually agreed upon
by the parties.
11. Any provisions in this Lease Agreement to the contrary
notwithstanding, Lessor expressly reserves the right to terminate this Lease,
upon sixty (60) days' written notice to Lessee, in the event that:

A. Lessor shall sell its property known as 31001 Lahser Road,
Birmingham, Michigan (located in Beverly Hills, Michigan), or enter
into an Agreement to sell said property; or
B. Lessor determines that the leased office space, which is the
subject of this Agreement, is needed by the Lessor for its own use.
12. In the event this Lease is terminated, pursuant to paragraph 11,
Lessor shall refund to Lessor, if applicable, an appropriate prorated portion
of any payments previously made by Lessee in accordance with the provisions of
paragraph 4 above.
IN WITNESS WHEREOF, the parties hereto have set their hands the day
and date first written.
