MISCELLANEOUS RESOLUTION 90011

IN RE: DEPARTMENT OF SOLID WASTE - APPROVAL OF OPTION TO PURCHASE
ADDITIONAL ACREAGE AT THE SOLID WASTE FACILITY SITE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS the County is involved in the development of a solid waste
system; and
WHEREAS the County intends to locate a Waste-to-Energy Facility (Tam)
and Material Recycling Facility (MPF) in Auburn Hills near Giddings and
Brown Roads and has executed an option to purchase approximately 33 acres
in accordance with Miscellaneous Resolution #89338; and
WHEREAS with an additional 6.86 acres along the west edge of the
optioned property, it may be possible to install electrical equipment on
site to interconnect with the Detroit Edison Power lines thereby
eliminating the need to interconnect at substation located approximately
three miles away; and
WHEREAS this offers the potential of avoiding $4.75 million in costs
to interconnect at the remote location which would be offset by $754,600
cost of this property for a savings of approximately $4 million; and
WHEREAS obtaining an option to purchase this additional property is
prudent during the planning process for the WTE.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of
Commissioners hereby directs Corporation Counsel to amend the existing
option to include additional acreage for electrical interconnect
equipment.
BE IT FURTHER RESOLVED that the price for the additional acreage
cannot exceed the price established in the existing option and the cost
for this option shall not exceed $7,000 which is authorized from the
Department of Solid Waste Professional Services line item
(4-10100-101-01-00-3128) and shall be recovered from the sale of bonds for
the solid waste system.

BE IT FURTHER RESOLVED that the Oakland County Board of Commissioners
hereby authorizes and directs the Chairperson of the Board of
Commissioners and the County Executive to execute the attached option to
purchase,
Mr. Chairperson, on behalf of the Finance Committee, I move the adoption
of the foregoing resolution.

ADDENDUM
OPTION TO PURCHASE
This agreement shall amend the Option to Purchase property in
the City of Auburn Hills, said option recorded in Liber 10987, page
267, Oakland County Records, between the County of Oakland, whose
address is 1200 North Telegraph Road, Pontiac, Michigan 48053
(Purchaser) and Anirjot Investment Co., whose address is 1245
Chicago Road, Troy, Michigan 48083 (Owner) as follows:
1. GRANT OF EXCLUSIVE OPTION. In consideration of the
payment to it of the sum of a non-refundable $7,000.00, the receipt
of which is acknowledge, the Owner hereby grants the Purchaser an
exclusive option to purchase additional property described below.
2. The property is described as being 200.0 ft wide, and
being parallel to and adjoining the westerly property line of the
hereinafter described property, being 6.86 acres, more or less.

PARCEL I: Part of the Northwest 1/4 of Section 3, Town 3
North, Range 10 East, City of Auburn Hills, Oakland County,
Michigan, described as beginning at a point on the North and South
1/4 aline of Section 3, located South 02 degrees 45 minutes 48
seconds East 1493.23 feet from the North 1/4 corner of Section 3,
Town 3 North, Range 10 East; thence South 02 degrees 45 minutes 48
seconds East 778.09 feet along the North and South 1/4 line; thence
South 87 degrees 14 minutes 12 seconds West 1287.80 feet to the
centerline of an overhead utility line; thence North 02 degrees 47
minutes 11 seconds East 36.37 feet along the centerline of said
utility line; thence North 02 degrees 46 minutes 20 seconds East
728.66 feet continuing along said line; thence North 00 degrees 45
minutes 58 seconds East 15.76 feet continuing along said line;
thence North 87 degrees 11 minutes 39 seconds East 1213.02 feet to
the point of beginning. Subject to the rights of the public and
of any governmental unit in any part thereof taken, used or deeded
for street, road or highway purposes.
PARCEL II: Part of the Northwest 1/4 of Section 3, Town 3
North, Range 10 East, City of Auburn Hills, Oakland County,
Michigan, described as beginning at a point on the East and West
1/4 line of Section 3, located South 02 degrees 45 minutes 48
seconds East 2986.57 feet to the center of said Section and South
86 degrees 58 minutes 50 seconds West 756.82 feet from the North
1/4 corner of Section 3, Town 3 North, Range 10 East; thence South
86 degrees 58 minutes 50 seconds West 601.08 feet along the East
and West 1/4 line; thence North 02 degrees 47 minutes 11 seconds
East 724.72 feet along the centerline of an overhead utility line;
thence North 87 degrees 14 minutes 12 seconds East 518.98 feet;
thence South 03 degrees 43 minutes 15 seconds East 718.74 feet to
the point of beginning. Subject to the rights of the public and
of any governmental unit in any part thereof taken, used or deeded
for street, road or highway purposes.
Parcel Identification No. 14-04-200-008 also covers other land
commonly known as: Vacant Giddings Road.
3. All terms and conditions of the Original Option to
Purchase shall remain in effect. This Addendum shall
terminate six (6) months from acceptance of this agreement.
4. OPTION PRICE AND METHOD OF EXERCISING OPTION: The
purchase price for the approximately 6.8 acres shall be at the
rate of $110,000.00 per acre. Purchaser may, at its sole
discretion, acquire the 6.8 acres, or any portion thereof.
All option monies paid to Owner by Purchase shall be credited
to Purchaser at closing in either election.
