Gosling, Chairperson RE: "504 Technical Assistance Advisory Council Bylaws TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Miscellaneous Resolution #82296, dated September 21, 1982, created an eleven-member "504" Technical Assistance Advisory Council in compliance with Section 504 of the Rehabilitation Act of 1973; and WHEREAS, said Council has been appointed by the Chairperson of the Oakland County Board of Commissioners and will be meeting on a regular basis; and WHEREAS. Miscellaneous Resolution #82296 directs that the Council prepare bylaws governing its functions, same to be approved by the Board of Commissioners; and WHEREAS, the "504" Technical Assistance Advisory Council and the Health and Human Resources Committee have reviewed the attached bylaws and recommend that they be adopted. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners does hereby approve the adoption of the attached "504" Technical Assistance Advisory Council Bylaws. Gosling, Ch`afrperson 1 it EREFf APPROVE THE FOREGOING RESOLUTION Date BY - LAWS 504 Technical Assistance Advisory Council Article 1 The name of the organization shall be the 504 Technical Assist- ance Advisory Council. Article 11 Purpose It is the purpose of the Oakland County 504 Technical Assistance Advisory Council to assist the County of Oakland in its efforts to comply with Section 504 of the Rehabilitation Act of 1973. Article III Membership The membership of the Council shall be appointed by the Chair- person of the Oakland County Board of Commissioners with the ad- vice of the Board of Commissioners. The number of members shall be as from time to time determined by the Board of Commissioners. Members shall be appointed for a one-year term; such terms ending at 12 o'clock midnight on December 31st of each year or until such time as their successor is appointed. Article IV Reporting Procedures With the assistance of the 504 Coordinator, the Council shall from time to time report its recommendations to the Board of Commissioners' Health and Human Resources Connittee, which will act as liaison committee to the Oakland County Board of Commissioners for the Council. Article V Meetings Regular Meetings shall be held once in each calendar quarter. Time, place and date shall be' established by the Chairperson of - the Council. Special meetings may be called by the Chairperson. Al: members will be notified of each meeting at least 14 days prior to the meeting. At the first meeting of each year, a general report of the activities of the Council for the year preceding shall be given. Minutes of each meeting shall be taken and dis- tributed to the members prior to the next meeting. Each member shall be entitled to vote on issues arising at each meeting. A majority of the active membership shall constitute a quorum and the Rules for the Oakland County Board of Commissioners shall govern the procedures at all meetings except as otherwise herein stated. Article VI Chairperson The Chairperson of the Council shall be appointed by the Chair- person of the Oakland County Board of Commissioners, with the advice of the Board of Commissioners. The Chairperson shall preside at all meetings, and shall make an annual report of the Council activities to the Health and Human Resources Committee of the Oakland County Board of Commissioners, and shall perform all functions usually performed by the Chairperson of an organization. Article VII Sub-Committees Subcommittees of the Council shall be appointed by the Chairperson of the Council for special projects of the Council. Such sub- committee appointments will be for a specific time but in no case longer than until the expiration of the term of the member so appointed. Article VIII Coordinator • The 504 Technical Assistance Advisory Council Coordinator shall be appointed by the County Executive and shall be responsible for carrying out the directives of the County Executive and/or the Board of Commissioners. Article IX Amendments These by-laws may be altered or amended by a 2/3 vote of the total members of the Council at any meeting. Notice of any proposed amendment shall be submitted in writing to the council members and to the Board of Commissioners thru the Health and Human Resources Committee, 30 days prior to the meeting at which that amendment is voted upon. All amendments so made must then be approved by the Board of Commissioners. Article X Actions in Conflict These by-laws shall not permit the Council to take any action in conflict with any policy or resolution adopted by the Board of Commissioners. Moved by Hobart supported by Moffitt the resolution be amended in Article III of the bylaws by adding in the second sentence after the words "shall be" '11 or' so the sentence would read: 'The number of members shall be 11 or as from time to time determined by the Board of Commissioners." A sufficient majority having voted therefor, the amendment carried.
