Calandro, Chairperson IN RE: PROBATE COURT - 1989 WAGE RE-OPENER AGREEMENT FOR EMP -oYEES REPRESENTED BY LOCAL 2437, CASEWORKERS AND NON-CASEWORKERS, C - 'NCIL 25, AMERICAN FEDERATION OF STATE, COUNTY AND MUNICIPAL EMPLOYEES, AFL-CIO TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Probate Court and Local 2437, Council 25, American Federation of State, County and Municipal Employees, AFL-CIO, have been negotiating a 1989 wage rate covering Caseworker and Non-Caseworker employees of the Oakland County Probate Court, pursuant to the 1986 - 1989 collective bargaining agreement; and WHEREAS an agreement has been reached with these employees for the period January 1, 1989 through December 31, 1989 and said agreement has been reduced to writing; and WHEREAS the agreement has been reviewed by your Personnel Conudttee which recommends approval of the agreement. NOW THEREFORE BE IT RESOLVED that the attached agreement between the Oakland County Probate Court, the Caseworker employees and Non-Caseworker employees, and Local 2437, Council 25, American Federation of State, County and Municipal Employees, AFL-CIO, be and the same is hereby approved; and that the Chairperson of this Board, on behalf of the Oakland County Board of Commissioners, is hereby authorized to execute the attached additional Letter of Understanding which continues to extend Merit System coverage to the employees covered by the agreement. Mr. Chairperson, on behalf of the Personnel Committee, I move the adoption of the foregoing resolution. PERSONNEL COMMITTEE MEMORANDUM OF AGREEMENT ,/,73V, - This agreement entered into this day of 1989 between the Oakland County Probate Court and Local 2437, Council 25, American Federation of State, County and Municipal Employees as follows: The parties agree that effective December 31, 1988 the attached salary schedule shall be in effect for employees represented by this bargaining unit and employed by the Oakland County Probate Court. This agreement is entered into pursuant to Appendix A, Salaries - 1989 contained in the 1986 - 1989 collective bargaining agreement between the Court and the Union. It is further understood that pursuant to Appendix B, Section IV the following modifications shall be made to the employee's fringe benefits: 1. An employee whose period of Long Term Disability commences on or after January 1, 1989 shall be eligible for County provided hospitalization/medical coverage for up to six (6) months from the date of Long Term Disability, provided the employee has applied for and has been denied health care coverage through other programs as identified by the Personnel Department and has no other hospitalization/medical coverage available and providing the employee has not allowed his/her hospitalization/medical coverage to lapse; 2. Effective January 1, 1989, those individuals employed on a full time basis on or before January 1 of a given year and who remain employed on a full time basis on December 1 of that year and who have at no time during that calendar year enrolled as a subscriber into one of the County employee hospitalization/medical plans, shall be paid a lump sum amount of one hundred thirty six dollars ($136-00) prior to the end of that calendar year. Such For the Probate Court, e E r / For the Union, / I /7 payment shall not be considered a part of salary for the purpose of computing service increment, overtime pay or other payments and shall not be included in the calculation of final average compensation for retirement purposes; 3. Employees hired on or after January 1, 1989, and employees rehired on or after January 1, 1989 who were not vested in the employee retirement plan at their time of separation, shall not be eligible for reimbursement from the County for Medicare Part B payments. 4. Effective January 1, 1989, all employees represented by this bargaining unit shall be eligible to participate in a Military Buy-back option as developed by the Oakland County Retirement Commission should it be approved by the Oakland County Board of Commissioners. APPENDIX A Salaries - 1989 I. The following merit salary schedule shall prevail effective December 31, 1988 for employees hired prior to May 5, 1987. Article IV - Adoption by Reference of Relevant Personnel Policies. All benefits and policies provided for in the Oakland County Merit System, which incorporates the Oakland County Merit System Rules Book, as amended and changed from time to time by resolution of the Oakland County Board of Commissioners, are incorporated herein by reference and made a part hereof to the same extent as if they were specifically set forth, except to the extent that such benefits and policies are inconsistent with this agreement. WILLIAM CADDEII, CHAIRPERSON IN RE: PROBATE COURT - 1989 WAGE RE-OPENER AGREEMENT FOR EMPLOYEES REPRESENTED BY LOCAL 2437, CASEWORKER AND NON-CASEWORKERS, COUNCIL 25, AMERICAN FEDERATION OF STATE, COUNTY, AND MUNICIPAL EMPLOYEES, AFL-CIO - MISCELLANEOUS RESOLUTION #89080 TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: Pursuant to Rule XI-G of this Board, the Finance Committee has reviewed Miscellaneous Resolution #89080 and finds: 1) This agreement, between the Oakland County Probate Court and Local 2437, Council 25, American Federation of State, County, and Municipal Employees, AFL-CIO, for the period January 1, 1989 through December 31, 1989 covers 145 Governmental Fund positions and one Special Revenue Position; 2) The 1989 Governmental Fund increase equals $175,268 of which $135,866 is salary increase and $39,402 is fringe increase as provided in Schedule A4 3) Funds are available and it is recommended that the 1989 Budget be amended reducing the Salary Adjustment and Fringe Adjustment Non-Departmental Accounts by $175,268 and increases the various units in the Probate Court as detailed in Schedule B. 4) The cost increase for one Special Revenue position is $2174 in Salary and $630 in Fringes for a total of $2804 which will be absorbed in the grant.
