Gosling, Chairperson IN RE: AGREEMENT WITH WATERFORD SCHOOL DISTRICT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, providing a quality education for youngsters in care at Children's Village is an essential service to the children residing therein; and WHEREAS, the Waterford School District provides for the staffing of the Children's Village School; and WHEREAS, the School Service Contract Executive Committee has developed a satisfactory contract, a formula for determination for staffing requirements and preliminary estimates of revenue and expenditures; and WHEREAS, the funding of this contract is subject to the County Board of Commissioners budget process. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the attached agreement with the Waterford School District. BE IT FURTHER RESOLVED that the Chairperson of the Oakland County Board of Commissioners be and is hereby authorized to sign the necessary document. Gosling, Chairperson Health & Human Resources Committee FROM James M. Brennan, Director - Program Evaluation & Operations Analysis SUBJECT: Waterford School District Contract for Teacher Services at Children's Village DATE: April 20, 1984 The renewal contract for the 1984-85 School Contract has been finalized. The following is a list of the differences from the current contract. 1. All references to Camp Oakland have been deleted. A separate contract will be negotiated with the Oxford School District for services to Camp Oakland. 2. On Page 2 in the Second Paragraph, the following sentence has been added. "The method used for determining the staff allocations shall be indicated in Addendum #1 attached." Addendum #1 contains the formula or methodology agreed to by the Executive Committee for determining student/teacher ratio. 3. Page 2, Third Paragraph, the words "staffing require- ments" have been substituted for the words "personnel assignments." The May 15 notification requirement is to apprise the County of the number of positions needed for the ensuing school year. Personnel assignments are handled by the Waterford School District in accordance with Paragraph 2, Page 2. 4. Page 2, Third Paragraph, the following sentence has been added "Addendum #2 identifies estimated cost and revenue." An addendum to the contract will contain the best estimate of costs, revenues and net costs that can be obtained at the time of contract approval. All parties to the agreement, understand that these costs would be rough estimates, and that more specific and accurate estimates and comparison to the prior year would be available at the time of the County's budget review. MEMORANDUM April 20, 1984, Page 2 5. Page 6, the 90 day notification provision was corrected to 60 days to be consistant with Page 5, Second Paragraph. In addition to the contract changes, the school district personnel have agreed to reduce summer school to half days, thus reducing teacher cost. They have also agreed to limit the budget for educational supplies to $50 per student. (Using the same student count as utilized for staffing requirements.) If new text book editions are required, it will be necessary for Oakland County to budget up to $2,000 to cover the one time cost. These budget changes are reflected in the estimated costs. JMB:eb Enclosures 1984185 SCHOOL YEAR AGREEMENT BE WATERFORD SCHOOL DISTRICT OAKLAND COUNTY PROBATE COURT -- JUVENILE DIVISION AND THE OAKLAND COUNTY BOARD OF COMMISSIONERS This Agreement is made and entered Into, by and between the Waterford School District (hereinafter called the "District"), Oakland County Probate Court -- Juvenile Division (hereinafter called the "Court"), and the Oakland County Board of Commissioners (hereinafter called the "County"). The purpose of this Agreement is to provide the framework for administering a continuing educational program for children placed by the Court in Oakland County Children's Village School. SERVICES OF COURT AND COUNTY The Court and the County will provide the facilities of the Children's Village School without cost to the District. The school year is considered to be July 1 to June 30. The Court and the County will notify the District by April 30 of the school year of the required staffing for the school for the following school year if this Agreement is to be renewed. If the Court and/or County decide it is necessary to reduce staff, the District will receive notice of the reductions no later than forty (40) days prior to the close of a semester, to be effective at the end of that semester. SERVICES OF THE DISTRICT In compliance with the laws of the State of Michigan, the District shall provide an appropriate educational program for each child assigned to Children's Village School. The appropriate educational program for each child shall be determined by the professional staff of the building with the approval of the building principal. The District shall assign teachers to Children's Village School on the basis of appropriate certification, qualifications, and seniority. The method used for determining the staff allocations shall be as indicated in Addendum #1 attached. The principal of the School will be consulted regarding specific qualifications of staff members before assignments are made. By May 15, the District will notify the Court and County of staffing requirements and estimated costs for salaries and fringe benefits for the next school year. In the event a contract between the District and the Waterford Education Association (WEA) Is not settled for the following year, current costs will be identified with the understanding that increases may occur. (Addendum #2 identifies the estimated costs and revenues.) By July 15, October 15, January 15 and April 15, of the school year the District will submit a billing to the County for expenditures for personnel. State or federal revenue applicable to Children's Village School will be determined by the net amount received from the state or federal government. The District will assume responsibility for payment of salaries and fringe benefits for personnel in accordance with the agreement between the District and the WEA. Fringe benefits are those provided in accordance with the union contract, plus those required by existing state law. Those required by existing state law are retirement, workman's compensation, and unemployment insurance. -2- PAYMENT FOR SERVICES The annual budget estimating gross expenditures and revenues shall be furnished by the Waterford School District to the Court and the County in accordance with the budget deadline as set by the County and in accordance with the County format for reporting. Quarterly payments of the approved estimated annual budget of net expenditures will be made by the County to the District on August 15, November 15, February 15 and May 15 for the calendar quarters ending September 30, December 31, March 31 and June 30. Any disagreement that may arise as a result of a quarterly billing shall be resolved, if possible, by a meeting of the parties. The party contesting the billing shall give the other party or parties ten (10) days written notice of the meeting and delineating the nature of the disagreement or dispute, and failure of the other party or parties to appear will resolve the dispute in favor of the contestant. Any adjustments made to the quarterly payment shall be reconciled through a separate billing. Upon filing the final report for the year, the refund to the County or monies due the District will be determined within thirty (30) days and reconciled as soon as possible. GENERAL 1. An Executive Committe shall be formed with the expressed purpose and function to: A. each agreement on the nature of the educational program. B. Review operating policies and procedures of the program. C. Determine budget. D. Develop methods for evaluating the program. -3- E. Recommend changes or modifications to program and/or budget. Committee membership will be comprised of: A. Director of Children's Services, Waterford School District. B. Assistant Superintendent (or designee), Waterford School District. C. Principal, Children's Village School. D. Management and Budget Department Director (or designee), Oakland County Executive Offices. E. Director of Juvenile Services and designee, Oakland County Probate Court, Juvenile Division. F. Director of Program Evaluation and Operations Analysis, Oakland County Board of Commissioners. Meetings may be called by a majority of the Executive Committee with five (5) working days' notice to all members. Decisions must be by unanimous agreement of: A. Assistant Superintendent (or designee), Waterford School District. B. Management and Budget Department Director (or designee), Oakland County Executive Offices. C. Director of Juvenile Services (or designee), Oakland County Probate Court, Juvenile Division. D. Director of Program Evaluation and Operations Analysis, Oakland County Board of Commissioners. II. Duration: This Agreement shall be for the fiscal school year of July 1 to June 30. In the event the parties wish to renew the Agreement, they will notify each other in writing by April 30, of the school year and shall immediately begin negotiations for the renewal of this Agreement. In the event there is a significant population change due to program modification or closure or renovation of a residential unit at Children's Village during the term of this Agreement, the following will occur: the -4- Executive Committee will convene to determine the level of services, staffing and appropriate contract cost adjustments which may be necessary as a result of such program or building modification. The Executive Committee will make every effort to maintain program quality. The Agreement may be terminated during its term by either party upon written notice of at least sixty (60) days. Upon such notice the parties agree to meet within thirty (30) days to review and evaluate the program, and to attempt to resolve the problems or concerns that prompted the termination notice. Procedure for notification is as follows: The Superintendent of the District will notify by regular mail the Chief Probate Judge and the Chairman of the Board of Commissioners (with copy to the County Executive). The Chief Probate Judge and the Chairman of the Board of Commissioners will notify by regular mail the Superintendent of the District (with copy to the County Executive). MISCELLANEOUS CONDITION in the event it Is necessary to close the Waterford School District because of financial conditions, the District will assist with the operation of Children's Village School in accordance with the laws of the State of Michigan and directives from the Michigan Department of Education. In the event the above condition occurs, the County agrees to continue advanced payment of the wages of those Waterford School District employees assigned and continuing to provide educational services to the Children's -5- Date: Witnesses: WATERFORD SCHOOL DISTRICT SUPERINTENDENT Date: Witnesses: OAKLAND COUNTY BOARD OF COMMISSIONERS CHAIRMAN OF THE BOARD Village School. The County agrees to continue to do so until such time as the District can resume payment of its staff or until such time as the Agreement shall be cancelled under the sixty (60) day notification provision.
