WIIIJAM CADDELL, CHAIRPERSON IN RE: DEPARTMENT OF INSTITUTIONAL AND HUMAN SERVICES/HEALTH DrvIsIcN ACCEPTANCE OF 1989/90 REIMBURSEMENT AGREEMENT FOR ENVIRONMENTAL HEALTH SERVICES TO MICHIGAN DEPARTMENT OF SOCIAL SERVICES LICENSED FACILITIES TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mt. Chairperson, Ladies and Gentlemen: WHEREAS, pursuant to Miscellaneous Resolution #89105 "Grant Application and Reimbursement Agreement Procedures (Revision #2)", the Health Division applied to the Michigan Department of Public Health (MDPH) for $54,222 in reimbursement funds to conduct inspections Of Department of Social Services licensed facilities for the period October 1, 1988 through September 30, 1989; and WHEREAS the MDPH, desiring to continue this contractual relationship for the ninth (9th) year has awarded the Oakland County Health Division a reimbursement contract to conduct said inspections in the same amount as applied for; and WHEREAS implementation of this agreement requires no additional County staff or resources; WHEREAS revenue for the service was budgeted at $48,638 in the 1989 Budget, this agreement will increase this amount by $6,584, which can be appropriated to the 1989 contingency account; and WHEREAS Corporation Counsel has reviewed and approved this agreement as to form; and WHEREAS acceptance of this agreement does not obligate the County to any future commitments. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accepts the 1988/89 Reimbursement Agreement for Environmental Health Services to Michigan Department of Social Services Licensed Facilities in the amount of $54,222. PURPOSE: To provide funding for environmental health inspections of facilities to be licensed by the Michigan Department of Social Services. . II. .OBjECTIVES: The primary objerrives of the agency's environmental health inspection program under this agreement are: A. To ensure a safe and healthful environment for individuals occupying these facilities through provision of effective environmental health inspections. B. TO effect timely responses to requests for inspections. C. To provide effective follow-up investigations. The agency will ensure the availability of inspection services to all Michigan Department of Social ServicPs lirensed facilities within its jurisdiction throngh the utilization of trained and ccuretent personnel. Inspections will be conducted and the program operated in accordance with the procedures established for this program. PROGRAM BUD= AND AGREDENT ANDLINt: The payment for environmental health inspections of the Michigan Department of Social Services" licensed facilities under the terms of this agreelrent may not exceed $74.47 per hour for services provided between October 1, 1988, and September 30, 1989, with a maximum of $54,222 provided by the state. This maximum amcunt may be increased throngh the redistribattan of available funds. A final adjustment:Twill be made based upon a statewide ratio of available 1988-89 fiscal year funds to actual allcwable local expenditures for October 1, 1988, through September 30, 1989. The allocation of these funds shall be at the discretion of the Department. IV. RESPONSIBILITIES - AGDICIT: The agency, in 'accordance with the general purposes and objectives of this agreement, will: Authority: Ant 280, 1939; Act 116, 1979; and Act 218, 1979 1:60 3/89 A. Conduct investigations and make reports on Michigan Depaetmeet of Social Servives° licensed facilities. B. Provide the necessary administiative, professional, and.teehnical'staff for operation of the program. C. Utilize standard records and recording forms as prescribed by the Department. Service sanmaries accompanied by necessary and appropriate service data shall be prepared and submitted to the Department, Division a Environmental Health, on a nonthly basis not later than the fifteenth (15th) of the following ooath. D. Maintain adequate program and fiscal records and files including source docueentation to support program activities and expenditures made under the terms of this agreement, as required. Such records will be maintained for a period of not less than three (3) years from the date of the submission of the final expenditure report or until audit findings have been resolved. F. Provide access to authorized representatives of the Department, the Michigan Department of Social Services, and the Comptroller General of the United States, or any of their duly aathorized representatives to all records, files, and doceuertation related to this agreement. G. Not Charge fees for services rendered under this agreement. H. Participate in administrative or court hearinge to provide expert testimony in respect to environmental health issues in accordance with Act 218, Public Acts of 1979, as amended; Act 116, Public Acts of 1973, as amended; and Act 280, Public Acts of 1939, as amended. Preparation for hearings may require on-site reinspections. I: Assure that all applicable federal and state laws, guidelines, rules, and regulations will be complied with in carrying out the terms of this agreement, including submission of a copy of any audit report related in whole or part to this program. J. Inform the Departmeet of any employee assigned to this program who has retired from State of Michigan employment under Acts 2 and 3, Public Acts of 1984 (Farly Retirement Program). A monthly report shall be required on the first of each month reporting the names of Stsee early retirants Tnjho performed work in the previous month on the program covered under this agreement. Such reports are not required for any State early retirant who reaches the age of 62 years. K. Submit examples of all proposed subcontracts to the department as part of the original plan and budget, for authorization under this nester agreement. Signed copies of subcontracts mast be submitted within 30 days of executioe and will teecme attaehments to this master ageeement. The Agency furthermore shall: • ' • (a) Require the contractor to comply with all applicable terms and ceeditions of this nester agreement. In the event of a conflict between this master agreeent and provisions of a subcontract, the provisions of this master agreement shall prevail. . . (b) Assume all responsibility for any work performed ender a subcontract Including appropriate compliance with all terms and conditions of the master agreement.- (c) Assure that any billing or request for reimbuesement for subcontract costs is supported by a valid subcontract and adequate source documentation on 'costs and services. -2-- V. RESPONSIBILITIES - DEENMENT: The Department, under the terms of this agreement, will: A. Provide staff for appropriate program and administrative consultation. B. Assist in the training of program staff. C. Provide payment in accordance with this agreement in an amount not to exceed $54,222 based upon appropriate reports, records, and documentation maintained by the agency and confirmed by the Department and in accordance with Appendices A and B. D. Outline data required for evaluation and operation of the program and assist the agency in identifying and securing the data. E. Provide any special reports and reporting formats required by the Depart-rent and the Michigan Department of Social Services for operation of this program. VI. DIRECTION END RELATED SERVICTs A. The inspection and related services for a foster family home, foster family group home, family day care home, group day care home, adult foster care family home, and adult foster care group farility (1 to 6 adults) will be done for a: 1. New home/facility and relocated hose/facility with private water supply and/or private sewage disposal system. 2. Special request related to environmental health, i.e., complaints or unusual situations requiring health department expertise and judgement, particularly as they may relate to water supply and sewage disposal. 3. Follow-up. The inspection and related services for an adult foster care small group facility (7 to 12 adults), adult foster care large group faoility, adult foster care congregate facility, adult foster care county infirmary, adult foster care camp, Child caring institution, children's camp, and Child care center will be done for a: 1. New facility, relocated facility, license renewal inspection, and when appropriate annual inspection. 2. Special request related to environmentAl health, i.e., complaints. 3. Follow-up. 4. Plan review. VII. SCOPE OF mispEcrim A. The scope of inspection for those types of homes/Earilities listed in VI-A includes private water supply and/or private sewage disposal (partial inspection). For special requests, the scope includes the private water supply and/or sewage disposal systems and also any other specific concern(s) Which generated the requPst. B. B. The scope of inspection for those types of facilities listed in VI—B includes private water supply, private sewage disposal, food service sanitation, insect and rodent control, solid waste disposal and collection, accident prevention, general houselvseping,'swimming pools, and bathing beaches (full inspection). For special requests, the scope includes the private water supply and sewage disposal systems and all of the general environmental health items with special emphasis on the specific item(s) which generated the request. . _ • VIII. STATUTORY AUTHORITY The appropriate parts of the statutory authority for the inspections of Adult Foster Care Facilities, Act 218, P.A. 1979; County Infirmaries, Act 280, P.A. 1939, as amended; and Child Care Organizations, Act 116, P.A. 1973, as amended, are contained in the most recent edition of the "Sanitarians Field Manual for Environmental Health Inspections of Department of Social Services' Licensed Farilities." The licensing rules to be followed When providing inspections and related services are those contained in Act 218, P.A. 1979; Act 280, P.A. 1939, as amended; and Act 116, P.A. 1973, as amended. IX. RESITOSE DIE TABLE Requests forenvironmeneal health services of the Department of Social Services' licensed farilities are to be honored according to the following table unless a longer time is specified on the request form: Routine Inspection Requests . . . . 30 days Plan Review Requests. . . 30 days Special Requests*..... * .009010 days *Special requests have been defined to include complaints or emergency situations involving environmental health. X. ‘'i ASSURANCES: In compliance with Title VI of the Civil Rights Act of 1964 and the Regulations of the U. S. Department of Health and Human Services issued thereunder, and section 504 of the Rehabilitation Act of 1973, and the Rules of the Elliot-Larson Civil Rights Act and the Administrative Procedures Act: The agency assures that, in carrying out this program, no person shall be e=luded fron participation, denied any benefits or subjected to discrimination on the basis of race, creed, age, color, national origin or ancestry, religion, sex, or marital status (except where bona fide occupational qualification exists). This policy of nondiscrinination shall also apply to otherwise qualified handicapped individuals. XI. PAYMENT PROCEDURES: ReiMbursement will be calculated and made by the Department on a quarterly basis from involves received. The amount of reimbursable 'time will be determined by multiplying the total number of partial inspection reports by one hour and the total number of full inspection reports by two hours. The total calculated hours will then be multiplied by the appropriate reimixaserrent rate. Invoices shall be prepared and submitted to the Michigan Department of Public Health, Office of Budget and Finance, Grant and Contract Plarxigenent Section, on a quarterly basis, not later than 15 days after the close of each quarter. AGREEMENT PETIOD: This agreement is in full force and effect from October 1, 1988, through SepteMher 30, 1989. This agreenent may be terminated by either party by giving sixty (60) days written notice to the other party stating the reasons for termination and effective date or upon the failure of either party to carry out the terms of the agreement, by giving ten (10) days written notice to the other party stating cause and effective dace. The Department may also terminate this agreement if the agency or a subcontractor, manufacturer, or supplier of the agency is sdbsequently found to engage in unfair labor practices. The Michigan Department of labor, pursuant to Section 2 of Act 278, Public Acts of 1980, shall determine those employers who are engaging in unfair labor practices. MI.
