'.1hY, Ex Miscellaneous Resolution # 89064 BY: PUBLIC SERVICES COMMITTEE - Richard D. Kuhn, Jr., Chairperson IN RE: 52ND DISTRICT COURT - CREATION OF CLERICAL AND MAGISTRATE POSITIONS TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS in recent years the 52nd District Court has experienced a dramatic increase in total caseload as well as a rise in the number of more complex cases; and WHEREAS the court has attempted to address the additional demands placed on clerical staff through the use of flex-time, overtime and temporary Emergency Salaries positions; and WHEREAS, despite these efforts, a substantial backlog of pending cases exists in Divisions I, III and IV; and WHEREAS due to the lack of availability of court time, there currently exists a four-month delay in scheduling traffic and civil infraction hearings and significant delays in scheduling other cases; and WHEREAS guidelines for time standards for processing cases recommended by the Michigan Supreme Court are not being met and delays are resulting in inefficient delivery of services to the public; and WHEREAS the 52nd District Courts have generated an increasing percentage of revenues over expenditures since 1983 and project that additional revenue will be realized to further offset the costs of requested positions; and WHEREAS the Personnel Department has conducted a review of the court's staffing needs and the County Executive recommends these additional positions. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners creates the following governmental positions in the 52nd District Court: Division I - three (3) District Court Clerk one (1) Magistrate - 2/5 funded PTNE Division III - six (6) District Court Clerk one (1) Magistrate - 2/5 funded PTNE Division IV - one (1) District Court Clerk - 1,000 hr/yr PTNE one (1) Magistrate - 2/5 funded PTNE Mr. Chairperson, on behalf of the Public Services Committee, I move the adoption of the foregoing resolution.
