Lanni, Chairperson IN RE: CITY OF ROYAL OAK ANIMAL CONTROL PURCHASE OF SERVICE AGREEMENT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the Oakland County Animal Control Division administers the provisions of P.A. 339 of 1919 as amended (the Dog Law), and WHEREAS the Animal Control Division also renders services to local jurisdicitions on Purchase of Service contracts, and WHEREAS the City of Royal Oak is seeking to purchase supplemental animal control services on a interim basis pending approval and implementation of a permanent contract, and WHEREAS the Oakland County Animal Control Division is in a position to accommodate the City of Royal Oak's request, and WHEREAS County and City officials have readied agreement with respect to scope of services and oompensation, and WHEREAS the government of Oakland County would recover 100% of its costs. NOVI THEREFORE BE IT RESOLVED that the Oakland County 'Board of Commissioners approves the attached agreement for animal control services between the County and the City of Royal Oak. BE IT FURTHER RESOLVED that the County Executive and Chairman of the Board are herewith authorized to sign the agreement on behalf of the County. Mk. PUBLIC SERVICES COMMITZEt; r - idEREI4*.PPROVE )1.-IE FOREGOING RESOLUTION • a • AGREEMENT FOR mumalamaiwagum THIS AGREEMENT made and entered into this by and between the COUNTY OF OAKLAND, through its Board of Com- missioners and the Oakland County Animal Control Division, here- inafter referred to as "COUNTY," and the CITY OF ROYAL OAK, here- inafter referred to as "cm." WITNESSETH: WHEREAS, the City is desirous of contracting with the County for the performance of Animal Control functions within its cor- porate limits by the County: and WHEREAS, the County is agreeable to rendering such services on the terms and conditions as hereinafter sat forth: NOW THEREFORE, IT IS AGREED AS FOLLOWS: 1. The County agrees to provide Animal Control protection within the corporate limits of the City, said protection to con- sist of the enforcement of City Ordinances, including the writing of tickets therefore: for the purpose of performing such functions, the County shall furnish and supply Animal Control Officers, as required, their supervision, equipment, communication facilities and other necessary supplies needed in order to perform such services, including all insurances, liability insurance and other protection or benefits of whatever nature. Notwithstanding any- thing heretofore contained, it is agreed that in all instances where special supplies, such as stationery, notices, forms, appearance tickets, and the like, needed to be executed in the name of the City shall be required, they shall be supplied by the City at its cost and expense. The County agrees to hold the City harmless and defend it against any suit, claim, cause of action, etc., as the result of any act, and/or omission to act, on the part of the County or its Animal Control officer employees (Animal Control Officers) and/or agents while such Animal Control offioor employees anoVor agents ire under the control of the oak-- land County Animal Control Division or its designated represent- ative, 2. The standards of performance, the discipline of the Animal Control Officer (s) and other matters incident to the performance of such services and the control of the Animal Con- trol officer Is) so issi9no4 to provide such service aimai maim in the County; however' the standards of performance shall not be lower than that furnished any city= township in 04klan4 county. but shall meet the statutory requirements of the 3.919 Dog Law; nor shall the caliber and the ability of the Animal control Officer(s) supplied be lower than that furnished other townships and cities in Oakland county. 3. The County shall submit time sheets and/or payroll records to City upon request. 7. This agreement may be terminated by either party with not less than thirty (30) days prior notice. B. The service herein provided for shall be limited to the corporate limits of the city. 9. William Caddell, Chairperson RE: Miscellaneous Resolution - CITY OF ROYAL OAK ANIMAL CONTROL PURCHASE 01,--S-ERVICE AGREEMENT_ TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: The Finance Committee has reviewed the subject resolution and finds that : 1) The City of Royal Oak is seeking to purchase supplemental animal control services on an interim basis pending approval and implementation of a permanent contract. 2) The County and City officials have reached agreement with respect to scope of services ansi compensation whereby the County would recover 100% of its costs. 3) The 1984 Budget for the period of May 10 - August 10 be amended as follows: Revenue 3-22100-178-30-00 -2605 3,600 Expense 4-10100-909-01-009903 Overtime 3,600 4) The interim contract shall be terminated upon implementation of a permanent contract between the City of Royal Oak and the County.
