RE: HOUSE BILL 5108 (SUPPORT) AUTHORIZING COUNTY CLERKS TO
WAIVE THREE-DAY MARRIAGE LICENSE WAITING PERIOD
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS as provided in Act 128 of the Public Acts of 1887 a
license to marry may not be issued until three days after application
unless the Judge of Probate waives the three -day waiting period for
good and sufficient cause; and
WHEREAS House Bill 5108 would amend this 102-year-old law and
place the responsibility of waiving the three -day waiting periods on
County Clerks rather than Probate Judges; and
WHEREAS since marriage licenses are issued by County Clerks,
it would be more practical to have any waiting period waivers also
come from that office; and
WHEREAS House Bill 5108 would simplify record keeping by
involving only one office in the marriage license process and it would
discontinue requiring a judge's time and attention on a matter not
demanding legal expertise.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board
of Commissioners supports House Bill 5108 which has passed the House
and awaits Senate consideration.
BE IT FURTHER RESOLVED that copies of this resolution be sent
to the State Senators from Oakland County, the Michigan Association
of Counties, and the County's Legislative Agent.
Mr. Chairperson, on behalf of the Government & Transportation
Committee, I move the adoption of the foregoing resolution.
