WILLIAM CADDELL, CHAIRPERSON IN RE: PUBLIC WORKS/FACILITIES ENGINEERING DIVISION - CONTRACT AWARD FOR WORK RELEASE FACILITY PARKING LOT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS by Miscellaneous Resolution #89232 the Board of Commissioners authorized the County Executive's Facilities Engineering Division to receive bids for construction of a new parking lot at Work Release Facility at an estimated cost of $186,000; and WHEREAS total project cost of $167,000 is lower than the original estimate since the current project does not include paving; and WHEREAS in accordance with bidding procedures, bids for the installation of the above mentioned were received and reviewed by the Department of Public Works on October 5, 1989; and WHEREAS the County Executive's Department of Public Works has reviewed all bids submitted and recommends that the lowest responsible bidder, ABC Paving Company of Trenton, Michigan be awarded for construction in the amount of $147,300; and WHEREAS additional costs are estimated to be $19,700; and WHEREAS the total cost of the above mentioned work is estimated to be $167,000 as detailed in the attached schedule; and WHEREAS funding for the above mentioned project is available in the 1989 Capital Improvement Program - Utilities, Roads and Parking Lots Section Fund #40200. NOW THEREFORE BE IT RESOLVED as follows: 1) The contract proposal of ABC Paving Company of Trenton, Michigan in the amount of $147,300 be accepted and the contract awarded in concurrence with the Planning and Building Committee recommendations, 2) Funds be provided in the amount of $19,700 to cover the remaining project costs, 3) That the designated contingency fund not be spent without prior approval of the Planning and Building Committee, 4) The Chairperson of the Board of Commissioners is authorized and directed to execute a contract with ABC Paving Company, of Trenton, Michigan on behalf of the County of Oakland, HERE2:: .1P_17,111,7 1T FCTIEGON3 RESOLUTION DMe nf-mraward 5) The County Executive's,Department of Public Works, Facilities Engineering Division, shall notify the awardee of this award, in writing no later than 10 days after adoption of this resolution. The award shall not be effective until the awardee has been notified. Mr. Chairperson, on behalf of the Finance Committee, I move the adoption of the foregoing resolution. FINANCE COMMITTEE Project No-: 88-27 10/17/89 OAKLAND COUNTY EXECUTIVE DEPARTMENT OF PUBLIC WORKS FACILITIES ENGINEERING DIVISION AWARD OF CONTRACT FOR WORK RELEASE FACILITY PARKING LOT In accordance with authorization received on September 14, 1989, in the form of Miscellaneous Resolution 89232, drawings and specifications for the Work Release Facility Parking Lot were prepared. The project was advertised and bids were received at 2 p.m., Thursday, October 5, 1989. These bids are summarized on the attached Bid Tabulation Sheet. The low responsible bidder was ABC Paving Company of Trenton, Michigan, with a bid of $147,300.00. This contractor has performed satisfactorily for us before, most recently on the Oakland/Troy Airport. The project is expected to be completed by January 1, 1990, and the total cost is estimated to be: 1. Construction $147,300.00 2. Landscaping 2,000.00 3. Maintenance Charges 2,000.00 4. Administrative Expense 500.00 Sub-Total $151,800.00 5. Contingency (10%) 15,200.00 Total Project Cost $167,000.00 Funding in the amount of $167,000.00 is available from the Utilities Section of the 1989 Capital Improvement Program. We are, therefore, recommending that a contract in the amount of $147,300.00 be awarded to ABC Paving Company. Further, we are recommending that total project funding in the amount of $167,000,00 be appropriated. PROJECT NO.: 88-27 CONTRACT NO.: 827 CONTRACT THIS AGREEMENT, made this the 26th day of October, 1989, by and between the County of Oakland, a Michigan Constitutional Corporation, acting herein through its Board of Commissioners, hereinafter called the "OWNER" and ABC Paving Company, 2650 Van Horn, Trenton, Michigan, 48183, hereinafter called the "CONTRACTOR." WITNESSETH, that the CONTRACTOR and the OWNER for the considerations hereinafter named agree as follows: The CONTRACTOR shall furnish all the materials, means of construction, and other accessories and perform all of the Work shown on the Drawings and described in the Specifications entitled: WORK RELEASE FACILITY PARKING LOT OAKLAND COUNTY SERVICE CENTER COUNTY PROJECT 88-27 AS PREPARED BY: The Facilities Engineering Division of the Oakland County Executive's Department of Public Works, all in accordance with this agreement, the General Conditions of the Contract, the Proposal, the Specifications, and the Drawings. The CONTRACTOR hereby agrees to commence Work under this Contract upon receipt of written notice to proceed, and shall fully complete the Work within Sixty (60) calendar days from the notice to proceed. The OWNER shall pay the CONTRACTOR for the performance of the Contract, subject to additions and deductions provided therein, as follows: One Hundred Forty-Seven Thousand Three Hundred and 00/100 ($147,300.00), which price is the base bid. The OWNER shall process payments on account of the Contract as provided therein, as follows: On or about the fifth (5th) day of each month ninety (90) percent of the value, based on the Contract prices of labor and materials incorporated in the Work and of the materials suitably stored at the site thereof up to the last day of the previous month, less the aggregate of previous payments; and upon substantial completion of the entire Work, a sum sufficient to increase the total payments to ninety-five (95) percent of the Contract price. The OWNER may at any time after fifty (50) percent of the Work has been completed, if he finds that satisfactory progress is being made and with written consent of :larety, approve any of the remaining partial payments for payment in full. Final payment shall be due thirty (30) days after completion of the Work provided the Contract is fully performed. Before final payment, the CONTRACTOR shall submit evidence satisfactory to the OWNER that all payrolls, material bills, and other indebtedness connected with the Work have been paid.
