IN RE: COMMUNITY DEVELOPMENT DIVISION - Criteria and Procedures for Spot
Rehabilitation for the Commercial Assistance Program (CAP)
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, Oakland County has been a recipient of Community Development Block
Grant funds from the U,S. Department of Housing and Urban Development since 1974 and
has operated a residential rehabilitation program since 1976; and
WHEREAS, the County of Oakland by Miscellaneous Resolution 482283 of
September 21, 1982 adopted the basic concept of utilizing Community Development
Block Grant funds to leverage private financial resources for the rehabilitation of
residential and commercial property; and
WHEREAS, the County of Oakland by Miscellaneous Resolutions #84239 of August
30, 1984 and 087134 of May 28, 1987 approved the Rehabilitation Leveraging Agreement
with Manufacturers National Bank of Detroit for a program of financing commercial
property rehabilitation; and
WHEREAS, the County of Oakland by Miscellaneous Resolutions #85158 of May
23, 1985, 486037 of February 27, 1986 and #87228 of September 3, 1987 designated
communities and funding allocations for the 1985, 1986 and 1987 Commercial
Assistance Programs; and
WHEREAS, the County of Oakland by Resolution 488141 of May 26, 1988 modified
the criteria and procedures for the reallocation of unused CAP funds; and

WHEREAS, in accordance with the provisions of HUD regulations, the Oakland
County Community Development Division has recommended criteria and procedures for
spot rehabilitation as described in Attachment A using funds from the CAP Loan Pool;
and
WHEREAS, the Community Development Citizens Advisory Council recommends
approval (by a 14 - 0 roll call vote) of the criteria and procedures for spot
rehabilitation as specified in Attachment A.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners
hereby authorizes the Oakland County Community Development Division to utilize the
criteria and procedures approved herein for spot rehabilitation using funds from the
CAP Loan Pool.
Mr. Chairperson, on behalf of the Public Services Committee, I move the
adoption of the foregoing resolution.

Attachment A
CRITERIA AND PROCEDURES
FOR SPOT REHABILITATION
Recommendation:
To date, the Commercial Assistance Program (CAP) has restricted rehabilitation to
buildings within a targeted business district documented as meeting one of the
national criteria; either prevention and/or elimination of slum and blight or
serving low and moderate income households. In an effort to meet the unaddressed
revitalization needs of qualified commercial buildings outside the target areas,
CAP proposes to make funds available to these businesses from the CAP loan pool.
Justification for spot Rehabilitation:
On September 5, 1989, The Royal Oak Tribune printed a general article about CAP.
As a result, the Community Development Division received over 44 telephone
inquires from business owners located in communities Who participate in the
County's Block Grant Program. The majority of these businesses are located
outside the CAP target areas. This indicates the need for commercial
rehabilitation financing outside the designated areas on a spot basis as provided
for in HUD regulations.
Eligibility:
Under spot rehabilitaion eligibility for CAP will be expanded to any commercial
property located in a CDBG participating community. To comply with federal
regulations, individual buildings will have to be qualified based on the specific
conditions of documented blight or physical decay. This will require the local
building official to prepare a building condition report based on local codes and
ordinances. The CAP architect will also contribute to this report. Eligible work
will be limited to correct specific conditions detremental to public health &
safety as defined by the Blighted Area Rehabilitation Act as amended by Public Act
320 of 1986.
Program Mechanics:
Once a building is determined eligible, the application process will follow the
current 18 month CAP participation plan.
Funds committed to a spot rehabilitation project will be deducted from a
community's CAP allocation as approved by the Board of Commissioner Miscellaneous
Resolution #88141 of May 26, 1988.
