Calandro, Chairperson IN RE: DRUG FREE WORKPLACE POLICY STATEMENT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS: Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Subtitle D of Title V, the Drug-Free Workplace Act of 1988 requires Federal Contractors/Grantees to provide a certified statement of compliance with the Act; and WHEREAS, the County of Oakland is a recipient of various federal funds and is designated as a grantee; and WHEREAS, compliance with the Act requires the publishing of a statement notifying employees about the establishment of a drug-free workplace policy; and WHEREAS, the County Executive has reviewed this proposal and recommends it adoption; and WHEREAS, it is the opinion of legal counsel that the Drug Free Workplace Policy Statement comports with federal law. NOW THEREFORE BE IT RESOLVED that the attached document shall be the County of Oakland's "Drug-Free Workplace Policy Statement". BE IT FURTHER RESOLVED that the County of Oakland will make a continued "good faith" effort to maintain a drug-free workplace. Mr. Chairperson, on behalf of the Personnel Committee, I move the adoption of the foregoing resolution. PERSONNEL COMMITTEE COUNTY OF OAKLAND DRUG-FREE WORKPLACE POLICY STATEMENT The Federal Drug-Free Workplace Act of 1988 imposes certain requirements on the County of Oakland and its employees as recipients of federal grant funds. The County of Oakland supports the purpose and goals of the Act and by this policy, announces its intention to comply with this Act and make continuing "good faith" efforts to provide a drug-free workplace. Therefore, it is the policy of the County of Oakland that any unlawful manufacture, distribution, dispensing, possession, or use of a controlled substance in the workplace is strictly prohibited. All employees of the County of Oakland must abide by the terms of this policy and must notify their Department Manager of any criminal drug statute conviction no later than five {5) days after such conviction. Employees violating this policy are subject to appropriate personnel/disciplinary action, up to and including termination, and/or other remedial measures as the individual circumstances warrant. The County of Oakland is committed to maintaining a drug-free workplace. All employees are expected to cooperate and give this policy their full support. 9/89 ii 14th this September 1989 4- .
