MISCELLANEOUS RESOLUTION 89021 February 9, 1989

TO: THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, Pursuant to provisions of 1988 Public Act 22 "Victim's
Rights Act," the Oakland County Probate Court is required to develop a program
to notify victims of their rights under the act and to respond to their
request for information and documents specified in the act;
WHEREAS, The Oakland County Probate Court, County of Oakland, has
developed the attached Proposal For Implementation of 1988 Public Act 22
"Victim's Rights Act" for the budget year January 1, 1989 through December 31,
1989; and
WHEREAS, The Health and Human Services Committee has reviewed this
Proposal and recommends its approval by the Oakland County Board of
Commissioners;
NOW/ THEREFORE, BE IT RESOLVED, That the Oakland County Board of
Commissioners authorize approval of the Proposal for the Probate Court
Victim's Rights Unit to comply with the 1988 Public Act 22 "Victim's Rights
Act."

Mr. Chairperson, Ladies and Gentlemen: -•_.
The Personnel Committee, having reviewed the Miscellaneous
Resolution #89021 titled "Probate Court - Oakland County - Juvenile Crime
Victim's Rights Act", reports with the recommendation that the resolution be
adopted with the following changes:
1. That the following be added as a 4th paragraph:
"WHEREAS if full reimbursement by the State of
Michigan should cease these positions shall be brought
back to the various committees and Board of Commissioners
for review."
2. That the following be added as a 6th paragraph:
"BE IT FURTHER RESOLVED that a new unit titled
"Victim's Rights" be created in the Legal Processing
Division of Probate Court, and that one (1) governmental
position of Clerk III, and one (1) governmental position
of Typist I be established within the new unit."

acceptance of the foregoing report.

The Chairperson referred the resolution to the Personnel Committee and
the Finance Committee. There were no objections.

1988 PUBLIC ACT 22
'Victim's Rights Act"
1988 Public Act 22 became effective in Michigan on June 1, 1988. It requires
the juvenile courts to provide services to victims similar to those that the
prosecutor provides for cases moving through the criminal courts. We are
advised that the state will refund actual costs incurred pursuant to the act
so we may be adequately staffed and equipped for this mandate.
It is proposed that a Victim's Rights Unit within the Legal Processing
Division of the Probate Court composed of one Clerk III and one Clerical
Trainee be established. This unit will be responsible for: (1) the
preparation of notices to victims; (2) respond to inquiries about victim's
rights; and (3) respond to the specific requests of victims as specified in
the act. Copies of the initial material to victims advising them of their
rights is attached.
The Victim's Rights Unit will be responsible to follow through on each
request to assure that the victim receives requested information throughout
the life of the case (which may range from a few weeks to several years).
We are requesting funding as follows:
BUDGET YEAR - JANUARY 1989 TBRU DECEMBER 1989
I. Yearly Salary Cost - $44,975
This amount is based on one Clerk III position at the 1988 base rate of
$17,746, plus $7,081 (39.9% fringe benefits), total $24,827; one Typist
I position at the 1988 base rate of $14,402, plus $5,746 (39.9% fringe
benefits), total $20/148 for a total of $4/4975 for both positions.
II. Operating Cost (Estimated)
A. Equipment Rental - $756
1. Rental of two Electronic Memory Typewriters - Panasonic Disk -
$56 per month X 12 months = $672.
2. Rental of one Electronic Calculator - Sharp/TCA $7 per month X
12 months = $84.
B. Office Supplies (0.V.) - $143
Manila file folder - letter size - 500 (100 per box x 13.50 x 5 =
$67.50). Cost color coded labels - $5.55, starter set - $70.

C. Postage - $522
It is estimated that 318 letters were mailed during one quarter
(October - December 1988). 318 letters X 4 = 1,272 - 1,272 X .41 =
$522.
D. Miscellaneous Capital Outlay - $2,627
1. Two Desks - Steno - $1,452
2. Two Chairs - Steno - $324
3. File Cabinet - TAB - $800
4. File Supports - TAB - $51
(24 X 2.11 = $50.64)
E. Bldg. Space Const. Allocation - $1,898
This item is based on the use of 200 sq ft. of area at $9.49 per
sq. ft. (1989) rate) = $1,898.
F. Computer Service - Operating $3,024
Cost for operating a computer terminal teleprocessing availability -
$40 per month x 12 months - $480. Cost of computer terminal $40 per
month X 12 months = $480, and cost of processing - $172 per month X
12 months = $2,064. For a total cost of $3,024 for the entire year.
G. Computer Services - Deve1o2menta1 - $5,600
This cost is based on $35 per hour and an estimate of 160 hours to
set ut, the computer programming for this project. This estate was
suggested by Don Lee of the Computer Services Department.
H. Convenience Copier - $375
This item cost is based on 2,601 copies made during one quarter
(October - December 1988). 2,601 X 4 = 10,404 - 10,404 X .036 =
$375.
I. Stationery Stock - $150
This line item includes desk calendars, staples, tape dispensers,
pens, pencils, typewriter ribbons and other office supplies
necessary for the processing of paperwork. These items will be
purchased through the County Stationery Stock Office.

J. Print Shop - $300
This line includes the cost of quick copy of six separate forms,
self-addressed envelopes, and other printed items by the County
Print Shop.
K. Telephone Communications - $1,100
This line item includes the cost for two telephone sets (ten
button), line charge, and 1,000 local telephone calls made during
the budget year
Total Cost $61,470.
We plan to implement this project by hiring one Clerk III and one Typist I.
The above figures represent the employment of two persons.
Request for advanced funding and approval for the purchase of equipment has
been forwarded to Lansing.
1) Request for reimbursement of expenses for start up costs and our
initial cost has also been submitted.
2) Appropriation for the Juvenile court Victim's Rights Program in the
amount of $61,470 is, therefore, requested.

Mt. Chairperson, Ladies and Gentlemen:
Pursuant to Rule XI-G of this Board, the Finance Committee has
reviewed Miscellaneous Resolution #89021 and finds:
1) Oakland County Probate Court is required to develop a program for
compliance of 1988 Public Act 22 "Victim's Rights Act";
2) The attached proposal was developed to comply with said act;
3) Recommends approval of the proposal including the creation of a
Victim's Rights Unit, which include two new positions (one Clerk
III and one Typist I) within the Legal Processing Division of the
Probate Court as detailed in the attached Schedule.
4) It is anticipated that the State will reimburse the County for
this program;
5) If full reimbursement by the State of Michigan should cease these
positions shall be brought back to the various committees and
Board of Commissioners for review;
6) The 1989 Adopted budget be amended as follows:
