Olsen, Chairperson IN RE: CONT IN UED OPPO SITION TO M7Mm=i.mv=='ih -ATE AVOW ME PROPORTION THAT EXISTED IN 1978-79 TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Section 30 of Article IX of the State Constitution requires that State revenue be returned to local governments in the same proportion that existed in 1978-79; and WHEREAS, the State has not met this constitutional requirement thereby forcing local governments to bear a disproportionately large share of State budget problems; and WHEREAS, Senate Bill 476 was previously introduced which intended to relieve the State of a portion of its obligation to local units of government by counting as payments to local units of government the costs of functions assumed by the State after December 22, 1978; and WHEREAS, the Oakland County Board of Commissioners opposed this action by Miscellaneous Resolution #83359, dated December 8, 1983; and WHEREAS, an amended Senate Bill 476 has now been introduced which would specifically count as distribution to local governments the funds expended by the State for the care of mentally ill and developmentally disabled persons in State Institutions without concurring contractual agreements with the local governments involved; and WHEREAS, the consideration of such funds as payments to local units of government without concurring contracts or without a corresponding adjustment of the Headlee base year computation would be in violation of the Constitution. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners opposes the amended Senate Bill 476. BE IT FURTHER RESOLVED that the Board of Commissioners, in order to assure that local governments receive proper allocation under the Headlee amendment provision, directs Corporation Counsel to take whatever action may be necessary to challenge this matter in Court, at such time thdt Senate Bill 476 passes the legislature and is signed into law by the Governor.
