RE: Oppose Any Implementation of the Michigan Lobbvina Act
Which Would Inter ere with the Orderly Operation of
Local Government
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen;
WHEREAS. Act 472 of the Public Acts of 1978 (the Lobby Law) was
enacted on October 19, 1978; and
WHEREAS, this law aimed at regulating lobbyist activities has already
survived a protracted court challenge and still poses many unanswered questions
in connection with its belated implementation; and
WHEREAS, soon after being signed into law, litigation over the
constitutionality of Act 472 was started and the legal dispute dragged on until
last fall when the State Supreme Court upheld the constitutionality of the Act; and
WHEREAS, because of the lengthy legal dispute, Act 472 was in a state
of limbo for several years and was not given its January 1, 1984 effective date
until litigation was resolved; and
WHEREAS, as mandated in Section 16 of Act 472, the Office of the
Michigan Secretary of State has begun efforts to implement the Act; and
WHEREAS, it has become increasingly apparent that the rules required
for such implementation and articulation could result in costly inefficiencies
and undue interference with the conduct of local government: and
WHEREAS, the difficult task of implementing Act 472 is compounded
by the facts that many provisions of the Act are open to wide interpretation
and that many legislators feel that the Act has so many flaws it should be
totally restructured.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board
of Commissioners urges the State Legislature as it considers amendatory language
to Act 472 to eliminate arty provisions which in any way would interfere with the
orderly operation of local government.
BE IT FURTHER RESOLVED that copies of this resolution be sent
to all Oakland County legislators and to the County's Legislative Agent.
Mr. Chairperson, on behalf of the General Government Committee, I
move the adoption of the foregoing resolution.
