McDonald, Chairperson IN RE: SUBMISSION OF CHANCES IN MERIT SYSTEM RULE 14 - LEAVES OF ABSENCE WITH PAY TO THE OAKLAND COUNTY BOARD OF COMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS Section IV, Subsection A of the Merit System Resolution requires that all changes in the rules and regulations of the Merit System shall be submitted to the Board of Commissioners at a regular meeting of the Board and shall become effective thirty (30) days after such meeting unless objection is received in writing by the Chairperson of the Board of Commis- sioners, in which case the objection shall become a matter of business at the next meeting of the Board; and WHEREAS it has become desirable to make certain changes in the wording of Rule 14 - "Leaves of Absence With Pay" as detailed in the attach- ment to this resolution including the current and proposed wording; and WHEREAS your Personnel Committee has reviewed and approved these changes at its meeting of November 14, 1984. — NOW THEREFORE BE IT RESOLVED that the reading of this notice and the distribution of this notice and the attached copies of current Rule 14 and proposed changes jn Rule 14 to all Commissioners present and absent to be considered as the official submission to the Board of Commissioners of the described changes in Rule 14. PERSONNEL COMMIITEE / . • • Rev. 9/23/74 RULE 14 - LEAVES OF ABSENCE WITH PAY Section 1 COURT APPEARANCE LEAVE - DURING SCHEDULED WORKING TIME A. Definition Court Appearance Leave is an absence from work during scheduled working time, for which the employee is paid, as if he were at work, if the absence is caused by the employee being subpoenaed to appear in Court. B. Eligibility I. Only those employees who are subpoenaed or ordered to appear in Court during their regular working hours or employees not eligible for overtime (as defined under Rule 2 - Salaries) who appear in their own behalf durieg their regular working hours, will be eligible to use Court Appearance Leave. Employees eligible for overtime who appear in Court as volunteer witnesses or who appear on their own behalf will not be eligible to use this type of leave. 2. Employees, requesting the use of Court Appearance Leave, must show proof of subpoena and will be required to deposit all witness fees, less mileage payments, with the County Treasurer. 3. Only those employees appointed for 520 or more hours in a twelve month period are eligible for Court Appearance Leave. C. Effect of Court Appearance Leave on Annual and Sick Leave Employees on Court Appearance Leave will continue to accumulate Sick Leave and Annual Leave, as if they were at work. No time will be deducted from the 'employee's Sick Leave or Annual Leave accumulations while on approved Court Appearance Leave. Section II COURT APPEARANCE LEAVE - DURING NON-SCHEDULED WORKING TIME A. Definition This refers to the appearance in Court during non-scheduled working time by County employees whose presence in Court at this time is required because of their County position. B. Method of Payment I. The Court Appearance must be verified in writing by the Court involved. 2. 11 the employee is in a classification which is eligible for overtime compensation, such compensation, shall be made at the rate of time and one-half for all time spent in Court, with a guarantee of a minimum of two hours compensation per day. Page 1 Section ER JURY DUTY LEAVE A. Definition Jury Duty Leave is an absence from work for which the employee is paid, as if he or she were at work, if the absence is caused by the employee being ordered to serve as a juror. M.5. A. 27A-1307 provides that Count x Officers are prohibited from jury duty service and their names shall be struck from the qualified jurors list. County employees are not exempt from jury service and should serve as jurors unless excused by the Jury Commission. B. Eligibility 1. Employees requesting the use of Jury Duty Leave must show proof of being drawn for Jury Duty and will be required to deposit all fees received for such duty, less Mileage payments, with the County Treasurer. 2. Only those employees appointed for 520 or more hours in a twelve month period are eligible for this type of Leave. C. Effect of Jury Duty Leave on Annual and Sick Leave I. Employees on Jury Duty leave will continue to accumulate Sick Leave and Annual Leave, as if they were at work. No time will be deducted from the employee's Sick Leave or Annual Leave accumulations for the time served on approved Jury Duty Leave. 2. If the employee should become sick (as described in Rule 24 "Sick Leave") while serving on a jury and is unable to appear as a juror, the employee will be paid for that day or days and the time deducted from their Sick Leave accumulation. .=•n•••n•••n11•W RULE 14 - AMENDMENTS Section 1 1. Section I, B, I changed in accord with Section 13(a) of the Fair Labor Standards Act of 1938 as amended in 1974 and P. 541-113 Federal Register, May 7, 1973. Definition No change County officers and employees, qualified in accord with current state statutes, are not exempt from jury service and should serve as jurors unless excused by the Court. REASON FOR GRANGE M.S.A. 27A-1307, cited in current rule, has been repealed. Statute no longer has any prohibitions to jury service.
