Skarritt, Chairperson RE: SENATE BILL 915-SUPPORT REPEAL OF THE JAIL OVERCROWDING STATE OF EMERGENCY ACT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS Senate Bill 915 would repeal Act 325 of the Public Acts of 1982, known as the Jail Overcrowding State of Emergency Act; and WHEREAS last year Governor Blanchard refused to release state prisoners, defying a prison overcrowding statute, because he feared the released prisoners would be a public danger; and WHEREAS subsequent to the governor's refusal to release prisoners, the State Legislature enacted Public Acts 100 and 101 of 1987 repealing the Prison Overcrowding State of Emergency Act, in effect endorsing the governor's stand that public safety takes precedence over an overcrowding situation; and WHEREAS Senate Bill 915 which would repeal the county jail overcrowding act is consistent with the thinking of the governor and State Legislature regarding state prison overcrowding; and WHEREAS Sheriff Nichols supports Senate Bill 915, saying the Jail Overcrowding Act has no valid purpose, that it mandates putting 10% of the prisoners on the street and that it places insurmountable burdens on jail management. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners takes a position supporting Senate Bill 915. BE IT FURTHER RESOLVED that copies of this resolution be sent to legislators from Oakland County and the County's Legislative Agent. Mr. Chairperson, on behalf of the General Government Committee, I move the adoption of the foregoing resolution.
