In Re: DRAIN COMMISSIONER -- THE ESTABLISHMENT OF A LAKE LEVEL
FOR CRYSTAL LAKE
To the Oakland County Board of Commissioners
Mr. Chairperson, Ladies, and Gentlemen:
WHEREAS Act 146 of the Public Acts of 1961, the Inland Lake
Level Act, establishes a procedure for the establishment of a
legal lake level for inland lakes in the State of Michigan; and
WHEREAS Crystal Lake, approximately 51 acres in size,
located within the City of Pontiac, is an inland lake; and
WHEREAS the establishment of a lake level of Crystal Lake
under the Provisions of Act 146 of 1961 would provide for the
protection of the public health, welfare, and safety, and would
conserve the national resources of the state, and would preserve
and enhance property values around Crystal Lake; and
WHEREAS petitions have been received from freeholders owning
lands abutting on Crystal Lake in number equal to two—thirds
(2/3) of the freeholders owning lands abutting Crystal Lake; and
WHEREAS the City of Pontiac by resolution adopted on June 7,
1983 has authorized the advance of $200,000 to finance the entire
cost of construction of a lake level control structure to
establish and maintain the normal height and level of Crystal
Lake.
NOW THEREFORE BE IT RESOLVED that this Board
Commissioners, for the protection of public safety and to
preserve the natural resources of the state and to protect the
value of properties around Crystal Lake, deems it expedient to
determine, establish, and maintain the normal lake level of
Crystal Lake within the City of Pontiac, Oakland County,
Michigan, pursuant to the provisions of Act 146 of the Public
Acts of 1961, as amended.
By:
BE IT FURTHER RESOLVED that the Office of the Prosecuting
Attorney institute in the Circuit Court for the County of
Oakland, by proper Complaint, a proceeding to establish a level
for Crystal Lake.
BE IT FURTHER RESOLVED that the City of Pontiac will benefit
and shall bear the entire cost of the project, that the Drain
Commissioner accordingly prepare a Special Assessment District as
prescribed in Act 146, and that the future cost of maintaining
the level of said lake shall be borne by the City of Pontiac.
Mr. Chairperson, I move the adoption of the foregoing
resolution.
