Olsen, Chairperson RE: HOUSE BILL 5305 (SUPPORT) - Victim of Robbery or Criminal Sexual Conduct Need Not See a Weapon, but Rather Needs Only to be Caused to Reasonably Believe the Assailant Had a Weapon TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, House Bill 5305 would amend the Michigan Penal Code by adding clarifying language that a victim of a robbery or criminal sexual conduct need not see a weapon, but rather needs only to be caused to reasonably believe the assailant possessed a weapon; and WHEREAS, Oakland County Prosecutor L. Brooks Patterson supports this legislation, stating that a robbery or rope victim should not actually have to "test" whether or not the assailant has a weapon before submitting; and WHEREAS, House Bill 5305 would serve to improve the opportunity to prosecute robbery and criminal sexual conduct assailants by clearly permitting the victims to make a judgment on whether a weapon was possessed. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners takes a position supporting House Bill 5305. BE IT FURTHER RESOLVED that copies of this resolution be sent to the State Legislators from Oakland County and to the County's Legislative Agent.
