Gosling, Chairperson RE: PROBATE JUDGES' RETIREMENT- TAX DEFERMENT (2F CONTRIRriTinAd TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson. Ladies and Gentlemen: WHEREAS. Oakland County Probate Judges are covered for retirement pension purposes under the Probate Judges' Retirement Act, being Act 165 P. A. 19.54, as amended; and WHEREAS, the Probate Judges' Retirement Act was recently amended by Act 187 of the Public Acts of 1984, to provide for tax deferment of a Probate Judge's member contributions as provided under Section 414 (h) (2) of the United States Internal Revenue Code; and WHEREAS, Oakland County Probate Judges who are members of the Probate Judges' Retirement System desire to become covered under the tax deferment provision of the Probate Judges' Retirement Act, as amended, and the United States Internal Revenue Code. NOW THEREFORE BE IT RESOLVED that the County of Oakland hereby elects coverage for its Probate Judges as provided by the Probate Judges' Retire- ment Act, as amended, effective January 1, 1985, and requests that a copy of this resolution be filed with the Probate Judges' Retirement System and the Treasurer of Oakland County for the purpose of recording and implementing this action. BE IT FURTHER RESOLVED that member's contributions treated as employer contributions by this action shall result in a corresponding reduction in the member's cash salary and such contributions will not be included in the member's gross taxable income.
