KUHN, JR., CHAIRPERSON IN RE: PROSECUTOR DEPARTMENT - APPLICATION FOR 1987/1988 AUTOMOBILE THEFT PREVENTION AUTHORITY GRANT TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS Miscellaneous Resolution #86186, Revised Federal and State Grant Application and Reimbursement Contract Procedures, requires the Liaison Committee to review said application; and WHEREAS the Oakland County Prosecutor Department proposes to apply for funds from the Automobile Theft Prevention Authority established by Act 10 of 1986; and WHEREAS the Oakland County Prosecutor Department is proposing a program entitled "Oakland County Prosecutor's Anti-Auto Theft Program" in the amount of $55,908, of which. 100% is grant funded with no County Match required; and WHEREAS any proposed personnel changes will be reviewed by the Personnel Committee. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners authorizes the application of said grant in the amount of $55,908. BE IT FURTHER RESOLVED that the application of this grant does not obligate the County to any future commitment. PUBLIC SERVICES COMMITTEE REPORT TO THE PUBLIC SERVICES COMMITTEE BY: DEPARTMENT OF MANAGEMENTAND BUDGET IN RE: PROSECUTOR DEPARTMENT - 1987-88 AUTOMOBILE THEFT PREVENTION AUTHORITY GRANT APPLICATION Pursuant to Miscellaneous Resolution #86186 the Department of Management and Budget_has .reviewed the grant application and finds: 1) This is the first year of the grant which is scheduled to operate from May 1, 1987 through April 30, 1988. 2) Total expenses for the grant period are estimated to be $55,908, of which $33,302 is estimated for the remainder of 1987 as detailed on the attached schedule. 3) One (1) additional special revenue funded Assistant Prosecutor III position .has been requested for the project, the position must be approved by the Personnel Committee, 4) Project expenses are to be reimbursed 100% by the grant, thus the short-term financial implications for the County are minimal. However regarding the long-term, although there is no mandated continuationshould grant funding cease the County may be requested to 'directly fund the project. The program will achieve its goal by utilizing a specially designated assistant prosecutor assigned exclusively to combat auto-theft in Oakland County. The Auto-Theft Prosecutor will actively assist all Oakland County police agencies in their enforcement efforts by providing legal ' advice, preparing search warrants, preparing arrest warrant authorizations, and by providing direction for investigative efforts where necessary. The Auto-Theft Prosecutor will also aggressively utilize the chop shop legislation forfeiture provisions in .an effort to destroy the profitability of commercialized auto theft operations. It is contemplated he/she will also be designated the Special Prosecutor for criminal actions that are complex or highly involved, relating to auto-theft offenses, where the facts indicate a need for continuity from investigation through prosecution. The entire Oakland County Prosecutor's Office will continue to execute the prosecutor's "no-plea" policy in all auto theft, fraud and larceny cases. The Auto-Theft Prosecutor will also actively participate in the creation, drafting and support of new legislation designed to modernize the criminal law concerning auto-theft offenses. Specific attention will be given to legislation designed to deal with offenses such as body switching, re-tagging and insurance fraud. Finally, the Auto-Theft Prosecutor, acting in conjunction with the Oakland County Prosecutor's Police/Prosecutor Training Coordinator, will develop a training program for all assistant prosecutors with regular updates in order to insure that every assistant prosecutor who may handle auto-theft offense investigations or prosecutions, will have the expertise necessary to insure competent representation and conviction. The program will require that this person have the ability to successfully conduct both criminal and civil prosecutions under the chop shop laws and the Michigan Penal Code. This person must also have the ability to draft and submit for consideration to the legislative bodies in Michigan legislation designed to provide more effective tools in the fight against auto theft. Additionally, the prosecutor must have an ability to create training programs and impart knowledge to the other assistant prosesuting attorneys who work in the office to insure that they too, are able to successfully prosecute auto theft offenses. The experience and competency required for this enforcement responsibility is such that we have proposed and recommended an Assistant Prosecuting Attorney III at the starting level be utilized. The attorney will have a six month step increase pursuant to county payroll system policy during the first year, bringing the yearly salary expense for the first year to $38,444.00. Fringe benefits are calculated by county formula at 36 percent of salary. The remaining expenditures seen in the grant application are those necessary to the outfitting of an office for an assistant prosecuting attorney. They include such basic equipment such as desk and chairs, telephones, office supplies and office space itself so that the assistant prosecutor can successfully perform his functions. Clerical support for the Auto Theft Prosecutor will be provided by existing staff at the Oakland County Prosecutor's Office.
