WILLIAM CADDELL, CHAIRPERSON IN RE: PROSECUTOR DEPARTMENT - 1987/88 AUTOMOBILE THEFT PREVENTION AUTHORITY GRANT ACCEPTANCE TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS Miscellaneous Resolution #86186 requires the Finance Committee to review acceptance of all grants that vary less than fifteen (15) percent from original grant application; and WHEREAS by Miscellaneous Resolution #87037 the Board of Commissioners authorized application for Automobile Theft Prevention funds in the amount of $55,908 for the period May 1, 1987 through April 30, 1938: and WHEREAS the Prosecutor Department has received a grant award in the amount of $55,908, the same as the original application for the same time period; and 1,111EREAS the program is 100% grant funded. with no County match required; ancl WHEREAS the creation of one (1) special revenue funded Assistant Prosecuting Attorney IT1 position requires the approval of the Personnel Committee; and WHEREAS the grant agreement has been approved as to form by Corporation Counsel. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accept the 1987/88 Prosecutor Automobile Theft Prevention Grant in the amount of $55,908 and that the Chairperson of the Board be and is hereby authorized to execute the agreement, and to improve minor changes and grant extensions, not to exceed fifteen (15) percent variance which are consistent with the grant as approved. f.'nPr-"ROVE THE FeRF-GOING RESOLIMON' uf blni41. The grantee must submit another application if it wishes to continue the project beyond the initial grant period. The authority will base approval of continuation applications on the grantee's reports of prioraccomplishments. 2. IMPLEMENTATION OF PROJECT The grantee agrees to implement this project within ninety days following the grant award effective date or be subject to automatic cancellation of the grant. PROJECT MODIFICATION The grantee agrees not to make any modification of the approved project, including the project budget, without the prior written approval of the authority. 4. ENHANCEMENT OF EFFORT The grantee agrees that it shall not reduce its level of expenditures for automobile theft prevention below that which the grantee was spending as of February 25,1986. 5. EXPENDITURES A. The grantee understands and agrees that all expenditures from the grant will: (1) Be necessary for proper and efficient administration of the project and be allowable thereto - under the principles and standards provided herein. • (2) Be permissible under state and federal law and consistent with statewide policies, regulations and practices. (3) Be reasonable under established principles of evaluatio (4) Not result in a profit or other increment to the grantee or governmental unit. Be incurred on or after the date of authorization to proceed or the first day of the grant period, whichever is later, and on or before the end of the grant period. (6) Be reduced by all applicable liabilities. (7) Be adequately supported by source documentation. The authority will accept only those cost categories approved in the grant as eligible expenditures_ Any changes in cost categories require advance approval by the authority C. The grantee agrees to use the approved purchasing practices and bid procedures required by the applicable Community, agency or organization for expenditures involving project activity. The grantee agrees to maintain accounting records following generally accepted accounting procedures for the expenditure of grant funds. The grantee agrees to record all revenues and expenditures in a fund or account separate from the grantee's other funds or accounts. E. The grantee understands that all state agency projects must have a legislative budget allotment and/or approval by the Department of Management and Budget in order to accept authority funds. F. The grantee agrees to maintain all documentation for costs incurred for a three-year period following the final payment for the project. 6. EQUIPMENT A. The grantee understands that "equipment" is generally defined as any nonexpendable tangible personal property having a useful life of more than one year and an acguistition cost of $300 or more per unit. Items with a useful life of more than one year but with an acquisition cost of less than $300 will not be considered equipment for purposes of this grant. Any equipment purchased through a grant to a state agency must also adhere to all state equipment control procedures. The grantee agrees to limit use of funds for the purchase of equipment to those items specifically identified in the budget detail of the approved project application. C. The grantee agrees that all equipment purchased under the grant will be used continually for automobile theft prevention purposes not only during the period of the grant but for the entire useful life of the equipment. D. The authority will conduct periodic inspections of all equipment purchased, both during and after the project period to insure that the equipment is being utilized for automobile theft prevention purposes. If the authority finds the equipment still being used for the purposes for which it was purchased after three years, it will consider the project closed. E. The grantee agrees to abide by one of the following procedures if any item of equipment purchased with authority funds is subsequently found not to be used primarily for automobile theft prevention purposes: (1) in the case of an on-going project, the authority will deduct the adjustment cost from the next allocation. (2) In the case of a closed project, the grantee will sub direct payment to the authority F. If the authority determines that an item of equipment is not being used for automobile theft prevention purposes, the grantee agrees to make an adjustment The following list enumerates the adjustment procedures to be used for different circumstances where equipment is no longer used for automobile theft prevention purposes: (1) Sale or trade-in: If an item of equipment is sold or traded, the adjustment will be calculated by using the sale or trade-in price, or the residual value, whfchever is higher. (2) Scrapping: Sometimes an item of equipment can become completely worthless or used up prior to its anticipated life expectancy. In this case, the authority must inspect the equipment prior to its scrapping .to insure that it is worthless.. In the case of scrapped equipment, no . adjustment will be made. G. Residual value will be calculated on the straight line basis using the expected life years as outlined below: Office furniture, machines and equipment 10 years Automobiles 3 years Buses 9 years Light general purpose trucks 4 years Electronic equipment 8 years Electrical equipment 12 years Machinery 12 years Professional, scientific, controlling and photographic equipment 12 years 7. RELEASE OF FUNDS The authority agrees to make orant payments on a quarterly basis in equal increments. 8. RETURN OF UNEXPENDED FUNDS The grantee agrees to return all unexpended grant funds to the authority within 60 days after the project is completed. The check should be made payable to the State of Michigan 9. AUDIT AND REVIEW A. The grantee agrees to allow the authority and the State Auditor General and any of their duly authorized representatives access, for purposes of inspection, audit and examinations, to any books, documents, papers and records of the grantee which are related to this project. The authority will conduct periodic audits of the grant to ensure the grant money has been spent in accordance with Act 10, P.A. of 1986, the policies of the authority and this contract. B. The authority will conduct periodic program reviews of the project. The purpose of these reviews wiii be to determine adherence to stated project goals and to review progress of toe project in meeting its objectives. The grantee agrees to submit quarterly reports concerning the progress of the project. The grantee understands that failure to submit any required reports will result in the termination of the grant. AUTHORIZING OFFICIAL The grantee understands that the authorizing official is an individual authorized by the recipient unit of government or organization to enter into contracts for purposes of this project. The authorizing official may not serve as the project director. 11. FINANCIAL OFFICER The grantee agrees to select as the financial officer of this proect the person who has been assigned by the recipient unit of government or organization to supervise the financial matters of the grantee. The financial officer may not serve as the authorizing official or the project director. 12. EQUAL OPPORTUNITY A.
