WILLIAM CADDELL, CHAIRPERSON IN RE: FACILITIES ENGINEERING DIVISION - CONTRACT 7,7H-:. FOR TRUSTY CAMP ASPHALT PAVING TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: by Miscellaneous Resolution #8605:-; the Board of Commissioners authorized the County Executive's Department of Public Works to receive bids for Trusty Camp entrance road asphalt paving at an estimated cost of $50,000; and WHEREAS in accordance with bidding procedures, bids for the installation of the above mentioned were received and opened on August 13, 1987; and VMEPTAS the County Executive's Department of Central Services has reviewed all bids submitted and recommends that the lowest responsible bidder, Apex 2 ,ef:'-elt Paving Company be awarded a contract for Trusty Camp asphalt paving in the amount of $59,967.20; and WHEREAS the total cost of the above mentioned work is estimated to be $74,000 as detailed in the attached schedule; and WHEP.S funding for the above mentioned project is available in the 1987 Capital Impro7.;e:::;ert Program - Utilities Parking Lots and Roads Section. NOW 1.1-EREFORE BE IT RESOLVED as follows: 1) The contract proposal of Apex Asphalt Paving Company, Auburn Heights, Michigan, in the amount of $59,967.20 be accepted and the contract awarded in concurrence with the Planning and Building Committee recommendations, 2) Funds be provided in the alT.-(7,_ of $14,032.80 to cover the remaining project costs, 3) The Chairperson of the Board of Commissioners, is hereby authorized and directed to execute a contract with Apex Asphalt Paving Company, Auburn Heights, Michigan on behalf of the County of Oakland, 4) The County Executive's Department of Central Services, Facilities Engineering Division, shall notify the awardee of this award, in writing no later than 10 days after adoption of this resolution. The award shall not be effective until the awardee has been notified. Mr. Chairperson, on behalf of the Finance Committee, I move the adoption of the foregoing resolution. REPORT August 25, 1987 BY : Planning and building Committee-Anne M. Hobart, Chairperson IN RE: FACILITIES ENGINEERING DIVISION—AWARD OF CONTRACT FOR TRUSTY CAMP PAVING TO THE FINANCE COMMITTEE Nt. Chairperson, Ladies and Gentlemen: The Planning and Building Committee, having reviewed the • above-referenced matter, reports with the recommendation that a contract be awarded to Apex Asphalt Paving Company in the amount of $59,967.20, with a total project cost of $74,000.00. Mr. Chairperson, on behalf of the Planning and Building Committee, I submit the foregoing report. Planning and Building Committee CONTRACT NO.: 802 PROJECT NO.: 86-6 CONTRACT THIS AGREEMENT, made this the 3rd day of September, 1987, by and between the County of Oakland, a Michigan Constitutional Corporation, acting herein throuah its Board of Commissioners, hereinafter called the "OWNER" and Apex Asphalt Paving Co., 2219 Avon Industrial Drive, Auburn Heights, Michigan, 48057, a corporation of the State of Michigan, hereinafter called the "CONTRACTOR." WITNESSETH, that the CONTRACTOR and the OWNER for the considerations hereinafter named agree as follows: The CONTRACTOR shall furnish all the materials, means of construction, and other accessories and perform all of the Work shown on the Drawings and described in the Specifications entitled: OAKLAND COUNTY TRUSTY CAMP SITE WORK COUNTY PROJECT 86-6 AS PREPARED BY: The Facilities Engineering Division of the Oakland County Executive's Department of Public Works, all in accordance with this agreement, the General Conditions of the Contract, the Proposal, the Specifications, and the Drawings. The CONTRACTOR hereby agrees to commence Work under this Contract upon receipt of written notice, and shall fully complete the Work within forty-five (45) calendar days from the notice to proceed. The OWNER shall pay the CONTRACTOR for the performance of the Contract, subect to additions and deductions provided therein, as follows: A sum determined by the actual qUantities furnished and installed and the schedule of unit prices in the itemized Proposal signed by the Contractor. The Contract price, based on the estimated quantities, is: Fifty-Nine Thousand Nine Hundred Sixty-Seven and 20/100 ($59,967.20), which price is the base bid. The OWNER shall process payments on account of the Contract as provided therein, as follows: On or about the fifth (5th) day of each month ninety (90) percent of the value, based on the Contract prices of labor and materials incorporated in the Work and of the materials suitably stored at the site thereof up to the last day of the previous month, less the aggregate of previous payments; and upon substantial completion of the entire Work, a sum sufficient to increase the total payments to ninety-five (95) percent of the Contract price. The OWNER may at any time after fifty (50) percent of the Work has been completed, if he finds that satisfactory progress_ is being made and with written consent of surety, approve any of the remaining partial payments for payment in full. Final payment shall be due thirty (30) days after completion of the Work provided the Contract is fully performed. Before final payment, the CONTRACTOR shall submit evidence satisfactory to the OWNER that all payrolls, material bills, and other indebtedness connected with the Work have been paid. The following is a list of the Drawings and Specifications all dated July 20, 1987, which form a part of the Contract: SPECIFICATIONS: AB-1, IB 1-4, PF 1-4, G 1-2, GC 1-28, 01085 1-3, 01300 1-5, 01500 1-6, 02200 1-5, 02600 1-2 DRAWINGS: Cover Sheet and Sheet No. 1 IN WITNESS WHEREOF, the parties hereto have executed this Agreement in three (3) counterparts, each of which shall be deemed an original, in the year and day first above mentioned.
