Calandro, Chairperson IN RE: SHERIFF DEPARTMENT - CONTRACT FOR MARINE PATROL WITH HIGHLAND TOWNSHIP - 1987 SEASON-MR-87177 TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: The Personnel Committee, having reviewed Miscellaneous Resolution #87177, reports with the recommendation that the resolution be adopted with the following change: To amend the sixth paragraph to read, "BE IT FURTHER RESOLVED that I . the Oakland County Board of Commissioners create two (2) part-time non- eligible Marine Safety Deputy positions in the Sheriff Department, Protective Services Division, Marine Unit, to be funded 20 hrs./wk." And to add an additional paragraph to read, "BE IT FURTHER RESOLVED that the positions be utilized only to the extent that funds are available as provided through the contract." Mr. Chairperson, on behalf of the Personnel Committee, I move the adoption of the foregoing report. KUHN, JR., CHAIRPERSON IN RE: SHERIFFS DEPARTMENT - CONTRACT FOR MARINE PATROL WITH HIGHLAND TOWNSHIP 1987 SEASON TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Highland Township -;as requested the Oakland County Sheriff's Department to supply part-time officers for Marine Patrol in Highland Township for the remainder of the 1987 season; and WHEREAS, the Sheriff's Department has agreed to supply such Marine Officers on an availability hourly basia, the number of manhours to be determined in conjunction with Highland Township; and WHEREAS, the revenue generated by this contract will cover the expenses required to create two (2) Pcrt-Time Marine Deputy positions:; and WHEREAS, the County of Oakland shall be reimbursed for such services by Highland Township at the hourly rate of $12.50 for the 1987 season. NOW, THEREFORE, BE IT RESOLVED, that the Oakland County. Board of Commissioners approve the eecution of the attached contract consistent with provisions contained therein. Mr. Chairperson, on behalf of 'he Public Services Committee, I move the adoption of the foregoing resolu Lion, PU1 LIC SERVICES COMMITTEE Oakland County Board of Commissioners Miscellaneous Resolution # 87177 Date: August 13, 1987 AGREEMENT FOR LAW ENFORCEMENT SERVICES THIS AGREEMENT made and entered into this 1st Day of July, 1987, by and between the COUNTY OF OAKLAND, through its Board of Commissioners and the Oakland County Sheriff, hereinafter referred to as "COUNTY", and the Township of Highland, hereinafter referred to as "TOWNSHIP". WITNESSETH: WHEREAS, the Township is desirous of contracting with the County for the performance of Marine Enforcement functions the Township by the County; and WHEREAS, the County is agreeable to rendering such services on the terms and _conditions as hereinafter set forth; NOW THEREFORE, IT IS AGREED AS FOLLOWS: 1. -The County agrees to provide Marine patrol in Highland Township, said protection to consist of the enforcement of State statutes and the Township ordinances, 'including the writing of tickets therefore; for the purpose of performing such functions, the County shall furnish and supply part-time Marine officer(s), their supervision, equipment, communication facilities and ,other necessary supplies needed in order to perform such services, including all insurances, liability insurance and other protection or benbfits •of- whatever nature. Notwithstanding anything heretofore contained, it is agreed_ that in all instances where special supplies, such as stationery, notices, forms, appearance tickets, and the like needed to be executed in the 'name of the Townshp shall be required, they shall be supplied by the township at its cost and expense. The County agrees to hold the Township harmless and defend it against any suit, claim, cause of action, etc. , as the result of any act, and/or omission to act, on the part of the County, or its Marine officer(s) employees, and/or agents, while such Marine officer(s) employees and/or agents are under the control of the Oakland County Sheriff or his designated representative. 2. Th.e standards of performance, the discipline of the Marine officer(s) and other matters incident to the performance of such services and the control of the Marine officer(s) so assigned to provide such service shall remain in the County. 3. The Township shall not be required to assume any liability for the direct payment' of salaries, wages or other compensation to the County for any County personnel performing the services set forth in this document except as herein otherwise. specified. 4. The Marine enforcement service to be provided by the County shall consist of furnishing part-time Marine officer(s) for specified periods of time by the hour. The commencement time of the shift is to be determined by the usual shift starting and ending time established by the Oakland County Sheriff's Department. 5. The Township agrees to pay for such Marine enforcement service at the rate per Marine officer consistent with the attached payment schedule, such sum to be paid monthly. Billing shall commence on the date Marine officer(s) are assigned to the Township. Fractional months services will be prorated on a work day basis for the month involved. 6. This Agreement shall be effective July 1, 1987, and shall terminate December 31,. 1987, provided that said Agreement may be renewed for mutually agreed contract periods thereafter by the Township, at rates established by the County, by giving its intentions to renew said agreement in writing to the County at least 35 days prior to the exclira.tion• date. Said notice is to be sent to the Oakland County Executive and the Oakland County Sheriff, and be it provided further that either party hereto may elect not to renew same by giving written notice thereof to the opposite party at least 45 days prior to the expiration date. 7. The Township and/or the County may terminate said Agreement, upon thirty (30) days written notice delivered to the Oakland County Executive and the Oakland County Sheriff. WILLIAM CADDELL, CHAIRPERSON IN RE: SHERIFF DEPARTMENT - CONTRACT FOR MARINE PATROL WITH HIGHLAND TOWNSHIP - 1987 SEASON - MISCELLANEOUS RESOLUTION 1187177 TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS: Mr. Chairperson, Ladies and Gentlemen: Pursuant to Rule XI-G of this Board, the Finance Committee has reviewed Miscellaneous Resolution 1187177 and finds: 1) Highland Township has reqlested, and the Sheriff has agreed to supply two (2) officers for twenty (20) hours per week for marine patrol in the Township for the remainder of the 1987 season (approximately 8/14 - 9/30/87). 2) The Township will reimburse the County for the full cost of the officers and supplies at a rate of $12.50 per hour, no additional 1987 County funds are required. 3) Two (2) part-time Marine Deputy positions be established, with the approval of the Personnel Committee, in the Sheriff's Department, Protective Services Division, Marine Safety Unit. 4) The following amendments to the 1987 Budget are reeumffended: 3-10100-436-01-00-2531 Revenue-Salary Reimb. $3,500 4-10100-436-35-00-1001 Marine Safety Salaries $2,176 4-10100-436-35-00-2070 Marine Safety Fringes 28 4-10100-436-35-00-3342 Equip.
