IN RE: HOUSE BILL 4239 (Oppose) PROVIDES THAT SEIZURE OF PERSONAL
PROPERTY FOR DELINQUENT TAXES BE PERMISSIBLE RATHER THAN
MANDATORY AS UNDER THE EXISTING STATUTE
TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Mr. Chairperson, Ladies and Gentlemen:
WHEREAS, under existing law the treasurer of a
municipality is mandated, in the event of tax delinquency, to seize
personal property to offset the delinquent tax obligation; and
WHEREAS, House Bill 4239 would amend the General Property
Tax Act of the State of Michigan to make seizure of property by
treasurers permissive, rather than mandatory; and
WHEREAS, collection efforts are enhanced when taxpayers
are advised that state law requires seizure of personal property
when taxes are delinquent; and
WHEREAS, changing the law to remove mandated seizure would
make the tax collectors' job much more difficult.
NOW THEREFORE BE IT RESOLVED that the Oakland County Board
of Commissioners opposes House Bill 4239.
BE IT FURTHER RESOLVED that copies of this resolution be
sent to the legislators from Oakland County and to the county's
legislative agent.
Mr. Chairperson, on behalf of the General Government
Committee, I move the adoption of the foregoing resolution.
