Olsen, Chairperson IN RE: SUPPORT OF HOUSE BILL 53-53- WHICH LIFTS PRESENT RESTRICTIONS ALLOWING ALTERNATE MEMBERS TO SIT ON THE BOARD OF ZONING APPEALS TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS, Public Act 207 regulating City and Village zoning allows alternate members to be called to serve on a Zoning Board of Appeals only if a regular member is absent from or unable to attend two or more consecutive meetings or where a period of 30 days has elapsed; and WHEREAS, HB 5353 deletes the requirements outlined above and permits alternate members to be called to fill absences under any circumstances; and WHEREAS, by lifting the present restrictions on calling alternates to serve, the bill would increase the possibility that appeals are heard by a full board; and WHEREAS, having a full board hear appeals is extremely important because a majority of votes of the full body is needed to approve an appeal. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commis- , sioners supports House Bill 53S-3 which has passed the House of Representatives and awaits action in the Senate Committee on Local Government. BE IT FURTHER RESOLVED that copies of this resolution be sent to the four State Senators from Oakland County and to the County's legislative agent.
