BIDDING PROCEDURE
To the Oakland County Board of Commissioners
Mr. Chairperson, Ladies, and Gentlemen:
WHEREAS it is in Oakland County's best interest to stimulate as much
competition as possible when bidding capital improvement projects; and
WHEREAS those interests include dealing fairly, equitably, and in
a consistent manner with all contractors; and
WHEREAS under certain circumstances, current bidding practices could
be counterproductive to those interests.
NOW THEREFORE BE IT RESOLVED that the attached document entitled
UNIFORM CONSTRUCTION BIDDING PROCEDURE and dated October 24,
1985, be substituted for the uniform bidding procedure adopted and amended
on Miscellaneous Resolutions #7133 and #9294.
BE IT FURTHER RESOLVED that the October 24, 1985, UNIFORM
CONSTRUCTION BIDDING PROCEDURE be put into effect for all construction
projects advertised for bids after the adoption of this Resolution and said
bidding procedure documents be made a part of all general or special conditions
of projects which are being bid.
BE IT FURTHER RESOLVED that bid security in the amount of 5%
of the bid amount be made a standard practice.

UNIFORM CONSTRUCTION BIDDING PROCEDURE
OCTOBER 24, 1985
The following is a step-by-step procedure for the opening of all bids
received by the Department of Central Services for the County Board of
Commissioners. The same procedure is also recommended for use by other
County agencies so that all bidding of Oakland County capital projects
are done on the same general basis avoiding confusion and/or errors by
contractors bidding work through various County agencies.
(1) All bids will be opened at the place, date, and time that is
described in, and a part of, the Advertisement for Bids.
(2) The departmental representative responsible for the bid
opening will introduce himself and announce that it is now
o'clock, the time specified for the receipt of bids and no more bids
shall be received on project. (The closing of
receipt of bids will be exactly at the time specified.) Any bids
submitted after the closing will not be accepted.
(3) The departmental representative responsible for the bid
opening can introduce other County representatives, consultants, local,
State, and/or Federal representatives in attendance at the bid opening.
The departmental representative shall explain the bid opening procedure
to be used and what omissions will automatically prevent a bid from
being read. Bids not read shall be returned to the bidder as soon as
possible after the bid opening.
(4) The departmental representative shall proceed to open the bids
individually by announcing that he has a bid from the
company and then checking to insure that:
(a) A bid bond or other approved bid security is enclosed.
(b) The proposal has been signed and is on the form
specified.
(c) All addenda, if any, are acknowledged.
(d) Other documents and/or attachments required to be
submitted as part of the proposal are enclosed.
(e) The proposal form is completely filled out so that the
total amount of the bid can be readily determined.
(5) If any of the above items are missing or incomplete, the bid
will not be read, but instead, put back in the envelope and returned to
the bidder. If the above items are enclosed and all in order, then the
total base bid shall be read, along with the bid for any alternates
listed in the proposal. On unit price proposals, the individual unit
prices for the apparent low bidder shall be read after all of the total
base bids are read.

(6) It is recommended for clarification purposes that bidding
documents state: Written figures will take precedence over numerical
figures if they disagree in themselves.
(7) Whenever a bidder claims to have made a mistake, such mistake
must be called to the attention of the County and documented within 24
hours after the opening of the bids. If such notice and proof convinces
the County that an honest mistake has been made, the bidder will be
allowed to withdraw his bid, Such withdrawal could result in the
forfeiture of the 5% bid bond,

Miscellaneous Resolution #85303 adopted by the Oakland County Board of
Commissioners at their regular meeting held on October 24, 1985
with the orginial record thereof now remaining in my office, and
that it is a true and correct transcript therefrom, and of the
whole thereof.
