WILLIAM CADDELL, CHAIRPERSON ECONOMIC DEVELOPMENT DIVISION - RESOLUTION APPROVING PROJECT AREA AND PROJECT DISTRICT AREA (EVEREST ACADEMY PROJECT) - INDEPENDENCE TOWNSHIP - MISCELLANEOUS RESOLUTION #91063 TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: The Finance Committee has reviewed Miscellaneous Resolution #91063 and finds there are no fiscal implications. FINANCE COMMITTEE MISCELLANEOUS RESOLUTION NO #91063 April 11, 1991 RE: ECONOMIC DEVELOPMENT DIVISION RESOLUTION APPROVING PROJECT AREA AND PROJECT DISTRICT AREA (EVEREST ACADEMY PROJECT) - INDEPENDENCE TOWNSHIP BY: PLANNING AND BUILDING COMMITTEE, LARRY CRAKE, CHAIRMAN TO: THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairman, Ladies and Gentlemen: WHEREAS, there exists in the County of Oakland the need for projects to alleviate and prevent conditions of unemployment, to assist and retain local industrial and commercial enterprises in order to strengthen and revitalize the County's economy and to encourage the location and expansion of such enterprises to provide needed services and facilities to the County and its residents; and WHEREAS, the Economic Development Corporations Act, Act No. 338 of the Michigan Public Acts of 1974, as amended (the "Act") provides a means for the encouragement of such projects in this County through the County's Economic Development Corporation (the "EDC"); and WHEREAS, the EDC has commenced proceedings under the Act for the benefit of such a project (Everest Academy Project) and has designated to this Board of Commissioners a Project Area and Project District Area for its approval; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COMMISSIONERS OF THE COUNTY OF OAKLAND, as follows: 1. The Project Area, as described in Exhibit A attached hereto, as designated by the EDC to this Board is hereby certified as approved. 2. That, it having been determined that the territory surrounding said designated Project Area will not be significantly affected by the Project because the surrounding territory is devoted to commercial/industrial uses, a Project District Area having the same description as and boundaries coterminous with the Project Area herein certified as approved be hereby established. 3. That, it having been determined that there are less than eighteen (18) residents, real property owners, Of representatives of establishments located within the Project District Area, a Project Citizens District Council shall not be formed pursuant to Section 20(b) of the Act. 01" E. 05" E., 41" W., 05" E., 41" E. 05" E., 1325.08 feet; 641.54 feet; 455.40 feet; 330.00 feet; 455.40 feet; 350.15 feet EXHIBIT A A parcel of land located in the SE 1/4 of the SE 1/4 of Section 16, T4N, R9E, Independence Township, Oakland County, Michigan, described as: Beginning at the S.E. corner of said Section 16 and extending N. 88 degrees 20' 33" W., 1331.47 feet along the South Section line; thence thence thence thence thence thence to the N. 02 degrees 22' S. 88 degrees 12' S. 01 degrees 56' S. 88 degrees 12' N. 01 degrees 56' S. 88 degrees 12' East Section line; thence S. 01 degrees 56 41" W., 1321.74 feet along said east line to the Point-of-Beginning and containing 36.852 Acres of land. The North part subject to road right of way for Clarkston-Orion Road, both present and future. Also subject to easements and right of ways of records. Together with all and singular the hereditaments and appurtenances thereunto belonging or in anywise appertaining: To Have and to Hold the said premises, as herein described, with the appurtenances, unto the said party of the second part and to its successors and assigns, FOREVER. And the said party of the first part, for himself, his heirs, executors and administrators, does covenant, grant, bargain and agree to and with the said party of the second part, its successors and assigns, that at the time of the delivery of these presents he is well seized of the above granted premises in fee simple; that they are free from all encumbrances whatever except easements and restrictions of record and any applicable zoning ordinance, and that he will, and his heirs, executors, and administrators shall Warrant and Defend the same against all lawful claims whatsoever, except as aforesaid. EXHIBIT A Part of the SE 1/4 of the SE 1/4 of Section 16, T4N., R9E., Independence Township, Oakland County, Michigan described as: Commencing at the S.E. corner of said Section 16 and extending along the East Section line N. 01 degrees 56 41" E., 1,321.74 feet, (previously recorded as 1,322.00 ft.) and N. 88 degrees 12' 05" W., 350.15 feet to the Point of Beginning: thence S. 01 degrees 56' 41" W., 455.40 feet; thence N. 88 degrees 12' 05" W., 330.00 feet; thence N. 01 degrees 56' 41" E., 455.40 feet to the 1/16 line in Clarkston-Orion Rd.; thence N. 88 degrees 12' 05" E., 330.00 feet to the point of beginning and containing 3.45 acres of land, the north 33 feet subject to road right of way.
