SKARRITT, CHAIRPERSON IN RE: OAKLAND COUNTY INDIGENT HOSPITALIZATION PROGRAM TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS prior to October 1, 1991, Oakland County funded a Resident County Hospital Program (RCHP) administered by the Michigan Department of Social Services' Medical Services Administration (NSA); and WHEREAS through Medical Assistance Program Bulletin #5310 -91 -08, hospitals were notified that effective October 1, 1991 NSA would no longer process RCHP claims and that the hospitals should contact local DSS offices and Counties for the procedures to be followed after the effective date; and WHEREAS County Executive staff met with representatives of Oakland County hospitals during October and November to develop a program that would continue the County's commitment to support hospitalization for the indigent at current levels, yet allow for more efficient administration; and WHEREAS the hospitals and the County Executive have agreed to the program design specified in the attached agreement; and WHEREAS funds have been included in the 1992/1993 Recommended Biennial Budget for indigent hospitalization, this agreement requires no additional County resources and allows the County to more effectively control expenditures; and WHEREAS this agreement has been included in the County Executive's Contract Review process. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the Oakland County Indigent Hospitalization Program as detailed in the attached agreement, and authorizes the County Executive to execute said agreements with those hospitals listed in the agreement addendum. Martin Dir. of Management & Budget OAKLAND COUNTY, MICHIGAN INDIGENT HOSPITALIZATION PROGRAM This Agreement-Letter of Understanding is made between the County of Oakland (County), a Michigan Constitutional Corporation, located at 1200 N. Telegraph Rd., Pontiac, Michigan 48341, and Hospital (Hospital) , located at Whereas, the County is willing to continue its commitment to serving the hospitalization needs of the indigent who do not qualify for Medicaid or Medicare; and Whereas, the Hospital recognize the need to provide services to this population. Therefore, it is agreed between the County and the Hospital: 1) The Hospital will continue to provide hospital care for those qualified under criteria attached hereto as "Addendum A". 2) The County will commit three million, five hundred and fifty thousand dollars ($3,550,000.00) in 1992, and three million, six hundred and fifty thousand dollars ($3,650,000.00) in 1993, subject to appropriation by the Board of Commissioners, to be distributed to the nine (9) hospitals listed on "Addendum B" to serve the hospitalization needs for the indigent. 3) The Hospital will receive a maximum payment of $ in 1992, in quarterly payments of $ 4) Distribution of the County support will be made within the first fifteen (15) days of the quarter commencing with January 1992. 5) Distribution in 1993 will be based on 1992 days of care provided any adjustment required due to distribution of days of care will be made in the second quarterly payment in 1993. 6) The Hospitals will subject themselves to audits by their independent auditors or their association, with said results made available to the County. Said audit to include review of days of care provided, eligibility of population served, and that County per diem participation does not exceed reasonable cost. 7) The County reserves the right to review said audits and if deemed appropriate by the County to conduct its own audit at its expense. 8) This agreement may be modified or canceled by either party upon ninety (90) days written notice by either the County or the Hospital and on thirty (30) days notice by mutual consent. 9) The Hospital agrees to indemnify and hold the County harmless from any and all liabilities, suits, damages, etc., arising from the actions or omissions of the Hospital, its officers, agents and/or employees. 10) This agreement is subject to renewal for 1994 and beyond - such renewal will be subject to the approval of the Oakland County Board of Commissioners and the appropriate governing body of the Hospital. 11) In connection with services provided in conjunction with this agreement, the Hospital agrees not to discriminate against any patient and/or participant based on sex, race, religion, color, national origin or handicap, that meet the eligibility criteria set forth in "Addendum A". 4 ADDENDUM A OAKLAND COUNTY INDIGENT HOSPITALIZATION PROGRAM CLIENT ELIGIBILITY To be eligible for the Oakland County Indigent Hospitalization Program and individual must meet all the following criteria: I) Oakland County resident; 2) Between 21-65 years of age; 3) Not able to cover their hospital cost by any other means including personal income, private insurance, any other private third party payer, public insurance or other governmental benefit; Ineligible for medicaid disability. WILLIAM CADDELL, CHAIRPERSON IN RE: OAKLAND COUNTY INDIGENT HOSPITALIZATION PROGRAM- MISCELLANEOUS RESOLUTION #91XXX TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: Pursuant to Rule XI -G of this Board, the Finance Committee has reviewed Miscellaneous Resolution #91xxx and finds: 1) Beginning October 1, 1991, the state Medical Services Administration (MSA) ceased processing Resident County Hospital Program (RCHP) claims leaving the funding and administration of indigent hospitalization to Counties. 2) County Executive staff have met with representatives from Oakland County hospitals and have agreed to the program detailed in the agreement attached to the resolution. The agreement specifies that total funding will not exceed $3,550,000 in 1992 and $3,650,000 in 1993, with fixed payments being made at the beginning of each quarter to the hospitals under contract. Funding for the program is identified in the 1992/1993 Recommended Biennial Budget under the Department of Social Services; the following amendment is recommended to move that funding to a non-departmental account as follows: 1992 1993 4-10100-168-01 -00 -3128 Pro.
