HomeMy WebLinkAboutResolutions - 1991.05.23 - 18547May 9, 1991 MISCELLANEOUS RESOLUTION # 91102 BY: PUBLIC SERVICES COMMITTEE, RUTH JOHNSON, CHAIRPERSON IN RE: DEPARTMENT OF PUBLIC SERVICES/CIRCUIT COURT PROBATION DIVISION-STUDENT INTERN/CASE AIDE GRANT ACCEPTANCE TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS the original application for the Student Intern/Case Aide Grant (Probation Enhancement Grant) requested a funding level of $95,796, to cover the period October 1, 1990 through September 30, 1991; and WHEREAS the original grant award was for $23,949 to cover the period of October 1, 1990 through March 31, 1991; and WHEREAS this Student Intern/Case Aide Grant (Probation Enhancement Grant) has been awarded additional funding in the amount of $19,958, as approved by the Michigan Department of Corrections; and WHEREAS the award stipulates this funding level for the period of five (5) months only, effective April 1, 1991 through August 31, 1991; and WHEREAS the grant award for $19,958, in addition to the previous grant award for $23,949, represents a total funding level of $43,907; and WHEREAS the total award for $43,907 is approximately a fifty-four percent (54%) variance from the grant application of $95,796 as detailed in the attached schedule; and WHEREAS funding to continue the program beyond August 31, 1991 must go through another application process; and •WHEREAS the grant award contract has been reviewed and approved as to legal sufficiency by the Office of Corporation Counsel; and WHEREAS this program is 100% state funded and does not obligate the County to further commitment. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners accept the 1990-1991 Student Intern/Case Aide Grant (Probation Enhancement Grant) in the amount of $19,958. BE IT FURTHER RESOLVED that the future level of service including personnel, be contingent upon the level of state funding available for this program. BE IT FURTHER RESOLVED that the Chairperson of the Board is authorized to execute the grant agreement and to approve amendments and extensions up to fifteen (15) percent variance from the award, consistent with the agreement as originally approved. Telegraph Rd., North Office Building, Pontiac, MI 48053, hereafter referred to as the CONTRACTOR are hereby amended to read as follows: Section 2 - STATEMENT OF WORK 7. Commencing January 1, 1991, the CONTRACTOR shall submit to the STATE quarterly statistical and narrative program reports. The quarterly reports are to be submitted to the STATE by the 20th day after the end of each quarter. Section 4 - PERIOD OF PERFORMANCE The term of this agreement shall be from October 1, 1990 to August 31, 1991. Section 5 - COMPENSATION The STATE agrees to provide payment to the CONTRACTOR for allowable costs incurred during the performance of this contract. The maximum amount payable to the CONTRACTOR under this agreement is $43,907. Allowable costs are identified in the attached Budget Summary (Attachment B). The CONTRACTOR must secure the approval of OCC prior to the purchase of any equipment. This agreement is subject to availability of funding from the legislature. Payment for services shall be in accordance with the following schedule and terms: 1. The CONTRACTOR shall receive one-third of the total contract amount on or about October 1, 1990, December 1, 1990, and February 1, 1991. , 2. Subsequent payments shall be based on an advance and prior expenditures. a, The advance shall be equal to the advance payments which were provided during the first six months of this agreement. b. Payments may be adjusted to reconcile variances between the prior advances and reported expenditures. c. Payments shall be made upon receipt of program and expenditure reports as required in Section 2 of this agreement. 3. Any unexpended and non-encumbered funds shall be returned to the STATE within 30 days after the termination date of the contract. Returned funds shall be in the form of a check made payable to the STATE OF MICHIGAN and mailed to: . Office of Community Corrections Grandview Plaza Building P.O. This was a request for renewal and increase of a $67,000 grant for student interns for 89/90. The increases were requested primarily to fund more students (increase from 11.5 to 14) and a raise in pay for students (55.00/hour to $6.00/hour). For state fiscal year 90/91 the State Board decided to approve grants for only a six month period. The State Board approved funds to Oakland County for $23,949 to cover October I, 1990 to March 31, 1991. The State Board has now extended the grant to August 31, 1991. The reduced dollar amount represents a change in funding philosophy by the State Board. Whereas previously students had assisted in a wide range of services in the Probation Department, the State Board intends to eventually limit state funding of student interns to assistance in community service and more particularly only for community service in lieu of jail terms. The State funded six intern positions (at the $6.00 rate) for a period of six months. The expectation is that eventually all these interns will be involved in community service assistance. This reduction had no immediate impact of probation services since student intern numbers were down to seven in anticipation of the change. However, in the long run, a number of formerly student assisted tasks will have to be done by probation agents. These include supervision of low risk cases, orientation of new probationers, assistance in investigations, review of probation violations, and assistance in inter-county and state transfer of probationers. This will take probation agents away from higher priority assignments. In addition it will deprive students of valuable experience working in the criminal justice system. Further, the cut may eventually impact the county' ability to collect court costs and attorney fees since community service is offered as an alternative to those offenders who claim indigence. je ) 4 ) 5 ) 6 ) 7 ) 8 ) 9 May 23, 1991 FISCAL NOTE (Misc. 91102) BY: FINANCE COMMITTEE, DR. WILLIAM CADDELL, CHAIRPERSON IN RE: DEPARTMENT OF PUBLIC SERVICES/CIRCUIT COURT PROBATION DIVISION - STUDENT INTERN/CASE AIDE GRANT ACCEPTANCE - MISCELLANEOUS RESOLUTION #91102 TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: Pursuant to Rule XI-G of this Board, the Finance Committee has reviewed Miscellaneous Resolution #91102 and finds: 1) The original application for the Student Intern/Case Aide Grant (Probation Enhancement Grant) requested a funding level of $95,796, to cover the period of October 1, 1990 through September 30, 1991. 2) The original award was for $23,949 to cover the period of October 1, 1990 through March 31, 1991. 3) The Michigan Department of Corrections has awarded additional funding in the amount of $19,958 for this grant, to cover the period of April 1, 1991 through August 31, 1991. The grant award for $19,958, in addition to the previous grant award for $23,949 represents a total funding level of $43,907, as well as a fifty-four percent (54%) variance from the grant application of $95,796 as detailed in the attached schedule. Any additional funding for this grant beyond August 31, 1991 will require another application process. This grant award contract has been reviewed and approved as to legal sufficiency by the Office of Corporation Counsel.
