JOHNSON, CHAIRPERSON IN RE: PROSECUTING ATTORNEY - GRAND JURY APPROPRIATION TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS Mr. Chairperson, Ladies and Gentlemen: WHEREAS a 17-member Citizens' Grand Jury has been ordered commenced by the Oakland County Circuit Court bench to begin operation on May 1, 1991 for a six-month term with an option to extend the term an additional six months; and WHEREAS the Grand Jury is empowered to investigate unsolved murders, the illegal possession, distribution, manufacture, and/or delivery of controlled substances, and conspiracies or attempts to commit these offenses; and WHEREAS the Prosecuting Attorney's Office, under the coordination of Principal Attorney Lawrence J. Bunting, with the assignment of existing staff resources, shall be responsible for all costs for the implementation and convening of the Citizens' Grand Jury; and WHEREAS a budget appropriation of $75,000 for operating expenses will be necessary to conduct the Grand Jury proceedings as estimated by the Prosecuting Attorney. NOW THEREFORE BE IT RESOLVED that the Board of Commissioners recognizes the establishment of a Citizens' Grand Jury and authorizes the appropriation of $75,000 to defray operating expenses for such purpose. TYNER, CIRCUIT JUDGE Richard Thompson, Prosecuting Attorney for Oakland County, acting on behalf of the People of the State of Michigan, filed a petition requesting that this Court direct and order the empaneling of a citizens grand jury as provided under 1927 P.A. 175, as amended by 1970 P.A. 9. 2 10.¢. The Court has reviewed the petition and has heard the arguments supporting it. The Court finds there is probable cause to suspect that certain crimes and offenses have been and are being committed within its jurisdiction, that persons may be able to give material evidence respecting these suspected crimes and offenses, and that a citizens grand jury should be summoned. Now, by a majority of the Court sitting en banc, IT IS ORDERED that a citizens grand jury consisting of 17 members be empaneled in accordance with the laws of the State of Michigan. The term of this citizens grand jury is to begin on the date that the grand jury takes the oath as grand jurors in accordance with MCL 767.9. IT IS FURTHER ORDERED that this citizens grand jury investigate unsolved murders, the illegal possession, distribution, manufacturing, and/or delivery of controlled substances, and conspiracies or attempts to commit these offenses.
