MISCELLANEOUS RESOLUTION #11311

IN RE: HUMAN RESOURCES DEPARTMENT - FISCAL YEAR 2012 - FISCAL YEAR 2013
COLLECTIVE BARGAINING AGREEMENT EXTENSION FOR EMPLOYEES REPRESENTED BY
MICHIGAN NURSES ASSOCIATION
To the Oakland County Board of Commissioners
Chairperson, Ladies and Gentlemen:
WHEREAS the County of Oakland and the Michigan Nurses Association have negotiated a
collective bargaining agreement extension for Fiscal Year 2012 and Fiscal Year 2013 for approximately
92 Public Health Nurses; and
WHEREAS this agreement provides that wages will remain unchanged for Fiscal Year 2012; and
WHEREAS the parties have agreed to a wage and benefit re-opener for Fiscal Year 2013; and
WHEREAS this agreement provides for Emergency Manager language as required by statute to
be incorporated into the collective bargaining agreement; and
WHEREAS the agreement has been reduced to writing in the form of a Memorandum of
Agreement; and
WHEREAS this agreement has been reviewed by your Human Resources Committee, which
recommends its approval.
NOW THEREFORE BE IT RESOLVED that the Board of Commissioners approves the proposed
Memorandum of Agreement between the County of Oakland and the Michigan Nurses Association
covering the period of October 1, 2011, through September 30, 2013, and that the Board Chairperson on
behalf of the County of Oakland, is authorized to execute said agreement as attached.
Chairperson, on behalf of the Human Resources Committee, I move the adoption of the foregoing
resolution.

MEMORANDUM OF AGREEMENT
This agreement is entered into on this day of , 2011,
between the County of Oakland and the Michigan Nurses Association (MNA). The parties
agree to extend the provisions of the 2007 — 2010 collective bargaining agreement through
September 30, 2013, with the following exception:
The following hi-weekly salary schedule shall remain in effect for Fiscal Year 2012.

The parties agree to a wage and benefit re-opener for Fiscal Year 2013.
This agreement provides that an emergency manager appointed under the Local
Government and School District Fiscal Accountability Act may reject, modify or terminate the
collective bargaining agreement as provided within the Local Government and School District
Fiscal Accountability Act. The parties agree that in the event this law is repealed within the
the life of this collective bargaining agreement, this language shall be considered void and
voluntarily withdrawn by both parties.
The collective bargaining agreement shall only be modified as indicated above.

COLLECTIVE BARGAINING AGREEMENT EXTENSION FOR EMPLOYEES REPRESENTED BY

TO THE OAKLAND COUNTY BOARD OF COMMISSIONERS
Chairperson, Ladies and Gentlemen:
Pursuant to Rule XII-C of this Board, the Finance Committee has reviewed the above-referenced
resolution and finds:
1. The County of Oakland and the Michigan Nurses Association (approximately 92 Public
Health Nurses) have reached an agreement regarding wages and benefits for FY 2012.
2. The agreement provides that wages remain unchanged for all employees represented by
this bargaining unit for the period October 1, 2011 through September 30, 2013,
3. The parties have agreed to a wage and benefit re-opener for FY 2013.
4. Funding at the agreed upon wages and benefits for FY 2012 is included in the FY 2012
Adopted Budget. Therefore, no amendment is required.
