HUMAN RESOURCES COMMITTEE VOTE: Motion carried unanimously on a roll call vote with Hatchett and Greimel absent December 15, 2011 MISCELLANEOUS RESOLUTION #11316 BY: PUBLIC SERVICES COMMITTEE, COMMISSIONER JIM RUNESTAD, CHAIRPERSON IN RE: CIRCUIT COURT — CREATION OF A NEW CLASSIFICATION OF PERSONAL PROTECTION ORDER LIAISON AND RECLASSIFICATION OF A STAFF ATTORNEY POSITION To the Oakland County Board of Commissioners Chairperson, Ladies and Gentlemen: WHEREAS Public Act 388 of 1996 required the Oakland County Circuit and Probate Courts to establish a plan for the operation of the Family Division of the Circuit Court effective January 1, 1998; and WHEREAS this legislation which created the Family Division required the Circuit and Probate Courts to develop a plan to coordinate the services of agencies to promote more efficient and effective services to families and individuals; and WHEREAS this legislation placed jurisdiction of Personal Protection Orders (PPOs) within the Family Division, and 1997 revisions to the law and rules of procedures for handling PPOs requires coordination among courts when PPOs are issued and enforced, makes PPOs available to minors either as petitioners or respondents, and permits the filing of a PPO request anywhere in Michigan, without regard to residence; and WHEREAS in 2003, the Michigan Supreme Court required the Family Division to designate a central access point to provide the public and attorneys information regarding access to courts and court related activities; and WHEREAS as a result of this legislation, in an effort to provide services to victims of domestic violence, stalking, and sexual assault rape for those who petition the courts for personal protection orders; and WHEREAS the Women's Survival Center and later the Haven assisted the public with the processing of the Personal Protection Orders for victims until 2010 when the Judicial Support Division assumed the duties; and WHEREAS Circuit Court has had a Staff Attorney position (#3010403-10875) located in the Circuit Court/Family/Judicial Support Division performing these duties in part; and WHEREAS this position is no longer filled full-time and a review of the classification has been completed: and WHEREAS Circuit Court proposes to downwardly reclassify the Staff Attorney position (#3010403-10875) to a newly created classification titled Personal Protection Order Liaison in bargaining unit 021 to serve as a central point of contact between the Circuit Court staff and the general public regarding the personal protection order process. NOW THEREFORE BE IT RESOLVED that the Oakland County Board of Commissioners approves the position change as follows: 1. To create a new classification titled Personal Protection Order Liaison in bargaining unit 021 at the following salary range: Base 1 yr. 2 yr. 3 yr 4 yr 5 yr OT 840,988 $43,462 $45,938 $48,413 $50,883 $53,355 Non-Exempt 2. Reclassification of one (1) GF/GP Staff Attorney position (#3010403-10875) to Personal Protection Order Liaison. PUBLIC SERVICES COMMITTEE, Public Services Committee Vote: Motion carried unanimously on a roll call vote OAKLAND COUNTY MICHIGAN Class Title: Personal Protection Order Liaison Department: Circuit Court / Family Division Reports To: Chief, Adoptions and Juvenile Services A. DESCRIPTION GENERAL SUMMARY Under general supervision, serves as a central point of contact between the Circuit Court staff and the general public, regarding the personal protection order process. Serves as a resource on the dynamics of domestic violence for the clerical staff assigned to the Personal Protection Order (PPO) office and the Circuit Court, Family Division. Verifies that all necessary legal information is sufficient and accurate on forms and in conformance with court rulings. Coordinates the PPO process for cases involving domestic, stalking and sexual assault for petitioners. May also assist respondents when requested and appropriate. Makes recommendations for personal protection order cases to court administration. Provides case information and referrals to domestic violence shelters. Assists with coordinating motion dates. Responds to general questions regarding personal protection orders. Coordinates court procedures for PPO violations. Communicates changes of personal protection orders policies and procedures with clients, court staff law enforcement agencies and/or the general public. Forwards all PPO' s and subsequent pleadings to local law enforcement agencies and the Prosecutor's Office. Utilizes current county-wide and/or department specific software to complete assignments. SUPERVISION EXERCISED Functions as a leader over lower level staff. Plans, assigns, reviews, instructs, assists, and coordinates the work of these employees. TYPICAL DUTIES AND RESPONSIBILITIES Provides guidance to the staff and the general public with matters pertaining to the PPO process to ensure legal documents are processed accurately and efficiently. Reviews case information to identify relevant facts and issues. Analyzes issues pursuant to PPO guidelines to determine possible violations. Drafts ;notions and formulates a summary of findings and recommendations. Provides information to respondents and petitioners regarding court proceedings and Orders to Show Cause for court hearings. Conducts interviews with PPO petitioners and respondents who are involved in the various proceedings arising from the issuance., denial or violation of a PPO. Assists petitioners with pleadings related to the PPO process, including petitions, motions to modify, terminate or extend PPOs, motions for orders to show cause and motions for alternate service. Responds to walk in and telephone inquiries regarding PPOs. 011 Responds to requests from Family Division Judges regarding the various aspects of PPO procedure. Assists in docket management by prompt resolution of hearings on motion for orders to show cause by coordinating the process with the many stakeholders, including the Court Staff, the Oakland County Sheriff, Community Corrections, County Clerk, HAVEN, and the Office of the Prosecutor. Reviews foreign PPOs to assist with a determination that the factual circumstances constitute a violation of the foreign PP() Serves as a central communication point between the Circuit Court, the general public, office staff, and law enforcement agencies for PPO matters including violations and arraignments. Assists the Data Technology Unit with updating information on the County website pertaining to the PPO process as changes are made to the law or forms. Performs special liaison assignments for the Court upon request, including notification of attorneys, court personnel, and others involved in the PPO process. IMPORTANT NOTE: The primary purpose of this job description is to set a fair and equitable salary range for this job classification. Generally, only those key duties necessary for proper job evaluation and/or labor market analysis have been included. Other duties and responsibilities will be assigned by the supervisor. QUALIFICATIONS EXPERIENCE, TRAINING, KNOWLEDGE, SKILLS & ABILITIES A. REQUIRED MINIMUM QUALIFICATIONS I . Possess a Bachelor's Degree from an accredited college or university in pre-law, political science or a closely related field. AND 2. Have two (2) years full-time experience within a court or legal setting as a court clerk, caseworker, or clerical or administrative staff with experience in PPO law and practice. NOTE: Graduation from an American Bar Association (ABA) accredited Law School may substitute for one year of the experience in #2 above. 3. Pass the complete examination, including the employment physical established for this class. 4. Successfully complete the six-month probationary period. B. ADDYHONAL DESIRABLE QUALIFICATIONS Considerable knowledge of Circuit Court laws, practices, and procedures. 2. Considerable ability to perform legal clerical activities. 3. Considerable ability to COITIMUllicate and interact with the attorneys and the general public. 4. Considerable ability to follow oral and written instructions 5. Reasonable ability to utilize current word processing, spreadsheet, database, e-mail and Internet software. Circuit Court has proposed a plan to downwardly reclassify a Staff Attorney position to a newly created classification titled Personal Protection Order Liaison to serve as a central point of contact between Circuit Court staff and the general public regarding the personal protection order process. 2. The position changes will result in General Fund salary and fringe benefit savings of $15,711 for FY 2012 and savings of $24,239 for FY 2013 and FY 2014. 3.
