SC RESOLUTION October 26, 195,;: By: Mr. Clack IN RE; REPORT OF COMMITTEE ON LOCAL TAXES -- 1959 ASSESSMENTS FOR EIGHT MILE ROAD STORM DRAIN TO: THE OAKLAND COUNTY BOARD OF SUPERVISORS Mr. Chairman, Ladies and Gentlemen: Your Committee on Local Taxes reports that it has considered the assessments for the Eight Mile Road Storm Drain as set forth in Miscellaneous Resolution No. 3577 rtbs.::::,nted by the Drain Committee on October 5, 1959, and referred to the Committee on Local Taxes, Your Committee held a hearing on October 9, 1959, at 10:00 a.m in the Supervisors Room, Fourth Floor, County Office building, 1 Lafayette Street, Pontiac, and heard interested persons who appeared for the property owners of the area as well as officials of the Cities of Oak Park and Southfield. At this hearing your Committee was advised that the Cities of Oak Park and Southfield were considering resolutions to have tnis drain constructed under the provisions of Chapter 20 of Act 40 of the Public Acts of 1 as amended. Under this section of the Drain Cade the cost of the proiect would be assessed wholly against the public corporations. Your Committee continued this hearing on October 23, 1959, at 10:00 a.m. in the Supervisors Room and was advised at that time that the Cities of Oak Park and Southfield have adopted resolutions to have the drain constructed under Chapter 20 of the Drain Code and have executed petitions to the Drainage Board of Oakland County for this purpose. These petitions have been filed with the Oakland County Corporation Counsel in escrow with instructions to file the same with the Drain Commissioner of the County of Oakland whenever the existing proceedings in Circuit Court (Eight Mile Road Storm Drain Special Assessment District Taxpayers Association vs. Daniel W. Barry et al -- Chancery Case No. C-31465) shall be vacated by final Court order. 94, eZA- Lee FL Clack, Chairman Louis F. Oldenburg Alex Maier Misc.:, 3586 In view of the filing of these petitions by the Cities of Oak Fork and Southfield, your Committee on Loo-ai Taxes recommends that the matter of assessment of the 1959 taxes for the Eight Mile Road Storm Drain be referred back to the Drain Committee. MR.
